Finaly12202012 did you call the shelter? I called them in this morning. They will be able to help you. Here is the advice to other girls in similar situation.Call domestic violence hotline ask the address of one shelter for victims of domestic violence.Get some clothes, maximum 1 big suitcase and all documents.Leave a note just saying "I left".you have to leave a note in order for your spouse to understand you left not because someone kidnapped you.If you don"t have money to get a cab walk 2 or 3 blocks call 911 and tell them you fear for your life and you need help. They willl send it cops where you are and then tell them your story and ask them to take you to the shelter. TELL your family not to answer the abuser phone calls and tell them not to give any information where you are not even mentioning oh she is safe in a place for victims of domestic violence...zero information ok.The shelter will provide help giving informations about restraining order, legal aid etc.

Hi Guys,

I have followed this forum for quite some time now, but never really posted anything. Here’s the situation. My girlfriend filed the I-360 form about a year and a half ago and finally made it to the top of the stack. She received an RFE regarding “good faith”. Here is where we run into the problem. She submitted a handful of her wedding day photos, affidavits from friends and a phone bill with both names on it. The problem is they had separate bank accounts, the electric bill and the car they had were only in his name, any additional pictures they did have were lost during an eviction, and their old landlord if refusing to write a letter for some reason. She is going to write an affidavit in regards to all of this and is in the process of getting more affidavits from people who knew them when they were together, possible one from her ex-mother-in-law. That said, is they any advice or ideas that anyone may have that we may not be thinking of?

Thanks!

yanksrgrt226 having affidavits, pictures and just phone bill in name of both is not a good thing, they want to see commingling finances such as joint bank account, joint tax return, utilities bills in name of both etc..She can try to explain about it but keep in mind the proof she has is not enough. It does not matter if she submit 100 pictures and 20 affidavits, she has to prove commingling finances and commune residence.

Sandranj, in my case my husband was avoiding to pay taxes, he owned a lot of money in child support, never did tax returns. He did not want to open a bank account because he was scared that irs would freeze all his savings. We had all the bills on my name, I could not even put him on lease agreement because they check credit history. He did not have any bills on his name at all, not even one besides child support slips that were coming every month. I have tons of pictures with him for six years we were together but no bills at all. I think I will face the problem of proving bona fide mariage as well.

iank did you explain all these things you just told me in your affidavit? well 6 years living together probably they will understand more than ever that you were living with an abuser that did not step up to file your papers and that your relationship was a genuine relationship because you lived 6 years without having a green card.

Cielo your friend has to ask the Court permission to move out of the State with the children. She must prove the relocation will benefit the children and prove the relationship between the father and the children will not be harmed. You said she is moving to her sister house then probably she won't have a job right away and maybe the house won't be big enough for all of them to live confortable then the Judge may consider the children will live better with the father. What a suggest is a different scenario, she can go to a shelter for victims of domestic violence with the children and right away she should go to the Court to file for custody and once the custody is established she can ask the judge to move out of the State. It will be danger for her to do that living in the same house with him.WE have here several women that left their house with their children and went to shelters and the judge granted custody of the children. The shelter will help her with lawyer, social worker etc
