Can't he take his kids to canada and apply for their citizenship there?

Vawa2013, I think what your asking is a complex question that can only be answer by the attorney.

As far as I know, vawa can be applied within 2 years for a divorce. Not sure if the 12 year rule still applies. Its your choice if do not want to write beyond the day of the assault. Its up to the vawa unit whether they will consider that one incident or not. So give it a shot and see. If they need more evidence I am sure they will ask for a rfe. You can google for how to write a vawa petition and I think some of them do a good job of explaining how the vawa process works. It might have the answer you are looking for. We all just have our experiences of how our vawa petition went and what we did.

Write from the heart, dont google.. Nevertheless, his situation is more complex than the everyday Vawa cases.If he files and is denied???? he will be in line to be deported??? "AINT NOBODY GOT TIME FOR THAT" In a situation like this!!! he has to fast and pray that the God of Miracles performs one. I ddnt know about Vawa then by miracle I found out. There is hope with the pending reform.I will definitely keep him in prayer

vawa 2013 yes one instance of battery is enough.We have here in the VJ several girls who were battered once and had their Vawa approved,but of course if your wife/husband spit on you once or slap you once you don't have a Vawa case,you need to prove you were battered, and they consider you were battered when you were hit heavily with violent blows or subject to beatings or physical abuse.If you can prove the abuse it does not matter if happened once or ten times, if it happened yesterday or 10 years ago since you did not divorced more than 2 years agom

anajnic they are deporting just people that had their Vawa denied and have a PENDING I-485.

Vawa2013, one incident of abuse is enough but you need to explain in detail the abuse,circumstances that lead to abuse,if you reported the case,if not why,how you felt. You should tell like a story. Try and read murid2010 case on Vawa part 1 and 2. She has only one incident of abuse, she call the authorities. She was married for only a month when incident happen. VSC ask her to rewrite abuse with more explanation. Funny thing is she get approval after 6months. Just make sure you explained very well so you can avoid RFE.

hi Sandra happy holiday and god bless you for all the help and advice you been giving on this forum . just and update I call my immigration lady and she submitted the I-824 for with $405. money order about 6 weeks now for my children so am just patiently waiting for reply , also its been 5 months now since I get approval for my I-360 from Vermont and my case was transfer to my local office since dec 26th 20012 and I still have not heard from them and no interview date what can I do desperate to see my kids now its been 5 years I left a baby who is 8 years now who wont talk to me as he says I don't want him heeeeeeelpcrying.gifcrying.gifhelpsmilie.gifhelpsmilie.gifsad.png

I havent seen mines in 10, welcome to the club. Hang in there. Mines just got approved. I hope i do not have to wait that longggg. But it is what it is. Although my file moved quickly. I think ill have greencard in 3 months
