Congrats to those who got approvals.

I agree Sandra is truly a blessing.

I got my notice today and it says it was approved on May 1st and the notice was sent on the 20th of May.

My affidavit was about 30 pages long and I had it notarized. That was because I was showing a pattern of things. Unfortunately I had been mentally abused by my brother as well and my struggle for my right to live on my own terms has been since the last 7 years. So its truly a relief that just a few more months and I won't ever have to rely on anyone else in life except for God.

Apple2013 you don't need to be divorced.I posted a memorandum from USCIs stating about that i think 2 or 3 days ago.Chech some pages back.

Hi Sandra,

I meant I want to get divorce now because I really really don't want to have any connection with my husband at all. Now my vawa is approved, is it ok if I file self-divorce now when waiting for my AOS interview since the divorce process would take 6months -1 year?

Sandraj has explained this over and over time after time and has also provided a link stating that the approval of Vawa and Adjustment of status is independent of Divorce /separations or anything of that nature. Meaning, you can get Divorce , it has no bearing on the continued process,im your case and mines AOS

God really bless SandraJ yes

I read the latest memorandum on vawa. The require the alien to show good faith marriage, evidence of the abuse, established residence and good moral character. If u show a genuine case then there is no reason to deny. A lot of ppl role vawa because their i130 was denied or their petitioner withdrew their petition and they file false cases to evade immigration "marriage fraud" that's grounds for denial. Once s person prove that all they send to vsc is the truth their should be no reason they'll deny u. U statement need to address the intent of the marriage not solely or mostly abt the abuse their is supporting documents for that. Their of different type of abuse I never file for mental abuse though mental abuse always accompany physical abuse. I was honest. I met my husband fell in love and got married. If I withdraw my petition he will file for me he's just physical and I don't appropriate that. The length of ur affidavit is not won't determine ur approval its what u write and discuss in details. I focus my affidavit on our courtship the love I had when times were great and the love I still have for him and the passion I had to have a family of my own. My mom died when I was a year old and my dad was hardly in my life so family means a lot to me. When he was arrested when the neighbour first called the cops I bailed him out for $2500. I drop all charges against him even though my attorney advised me not to. He's my child's father and when immigration process is over he'll still be her dad so I'm not going to fight evil with evil. I'm a forgiving person because if he never married me and we lived together I couldn't file a petition. He loved me that's y he said I do. Ppl do things out of anger sometimes. He had a hard life and things like that take a toll on ppl. He don't know his dad and his mom died when they were young so they had a tough life. He's doing anger management and after that we are going to go for counseling.

If papers was my sole purpose I would have filed i130 when we just got married. My lawyer talked me into vawa because I really didn't want to take that route.

08/2012 Discussed my immigration issues with a lawyer

I completely understand how you feel! It is very hard to leave someone when you still love them but deep inside you know it's not right what you're going through. For me it was hard because I had a newborn I got so depressed. I couldn't handle it. It was the hardest year I have ever been through. Things are better now and sense I got my EAD I was able to get a good job and provide or my kids.

Even immigration was never your sole purpose for ur relationship and u establish a family with someone u no amount of green card can put ur family back together. Vawa is a long journey but when u gave a child with someone ur minimum encounter is 18years. And he loves his daughter despite how he nay feel towards me not saying he hates me but he has been helping with the baby in every aspect.

Sandranj is of course right re: length of statement. I wonder if (in howtosurvive's favor) one established (officially documented) instance of physical assault is enough for positive VAWA unit's ruling, even if the victim doesn't testify to mental harm associated with such assault

The cops were called to my apartment on several occasions by the neighbors and the building security. He was arrested twice. He threaten the cops and they also charged him with terroristic threats which racked up his bail. Its a lot of evidence I had. I prove to immigration that I had possessions before my husband. I drive a brand new 2012 car, I was in a nursing program when I met him I wasn't a bom. If they rfe me I will get a let from my ex who just made Chief in the navy who I dated for close to two years and I never ask him for papers gfe topic came up but I never influence him to marry me so I could get a GC I was living well off without papers (always had DL and SSC. We never work out Caz he was trying to make is relationship with his baby mother work for tfe sake of their young child. So I can show immigration I'm not desperate and fraudulent. My affidavit was the truth! Do was my best friend his sister and I are so close so is his family so if I get rfe I can get things from is family. His sister is spoiling my daughter Caz she's their first niece but she's older than him. Hus grandparents are coming up to see the baby next weekend she live out of state his step grandparents love me and the baby his aunt love us so my marriage was straight up bonafide. When I was leaving my country I told myself I'm going to America and I'm gonna marry only for love and tfats what I did. He's not my typical type but we fall in love out of our control sometimes. I didn't want to start writing a lot and then start lying because a person that love to talk always tell lies and vsc knows. A long affidavit shows that u are trying too hard to convince the adjundicater.

Again and again and again I applaud here all survivors who had the courage to say NO to the abusers. You are truly survivors.Abusers do not change. You can't give what you do not have, you can't love someone if you do not love yourself , and your life come first ALWAYS. Getting out of abuse showed you guys strength, determination and self respect.I am convinced each one of you will find a man/woman who will honor, respect and cherish your love and will show your love not with words, but with actions.Life is too short to spend it in poor relationship then go get it.

I think i mentioned here besides being a lawyer I am one of the United Nation advocates for victims of domestic violence as well. I would like to invite all survivors living in NYC and NJ to take action on Orange Day which will take place in July 27 at 2pm in New York City. The event is to highlight the issue of violence against women/men and children.I am still choosing between Central Park and Time Square. I will give to each survivor a orange tshirt with the United nation logo printed "To End Domestic Violence-United Nation". Please send me pm who wants to take part . The pictures will be published in the United Nation web site, but if you don't want to show your face we won't display your face.

I will briefly explain about all forms of domestic violence. We have to condemn domestic violence.Inflicting pain on others is morally wrong and a crime. Abuse can ever be justified.

"We challenge the culture of violence when we ourselves act in the certainty that violence is no longer acceptable, that's is tired and outdated no matter how many clingy to it in the stubborn believe that it still works and that it's still valid. (Gerard Vanderhaar)
