Timeline

domi-nique Chicago takes 5/6months to ship the case to Uscis local office, but i had one case this week they set up interview after 2months that Chicago received the form I-485.I was surprised,but I am not sure if they changed the timeline or if she got lucky.

With the help of merciful god my VAWA is approved.I will have AOS interview now.

I am on probation for a first DUI for another year & some months.Will that create

any delays? Has anyone received there GC while on Probation?The vawa officers

already knew about this probation.DUI was the worst mistake of my life in my depressed

times.I am very anxious , Please provide some guidance.

Coming back to howtosurvive (she said she'd filed thru an expensive attorney): she said her affidavit was 2 pages. So my question addressed one precise point: under VAWA, if there is official evidence of having suffered a physical assault, while living with spouse (one time instance of battery) - does any other abuse needs proof, or does mental harm needs proof?

vawa2013 having a police and/or a restraining order is not sufficient to have a Vawa case approved, the alien must tell Vawa Unit about the abuse suffered as well. As i said before one girl here was battered,stayed in the hospital twice, her husband was arrested 4 times, they asked her to emend her affidavit,because she failed to tell about the abuse in details. We have one girl here in the Vawa thread that her divorce was finalized with base in domestic violence,she had a child with the abuser, she had police report and restraining order, but her Vawa was denied, they said she could not prove domestic violence.She refiled.As you can see to have a Vawa case approved you need to prove a lot of things and to do a lot of thing as well ,such as getting good affidavits from friends, draft an amazing affidavit etc.

my affidavit wasn't notarized and it was about 2 -3 pages long. And I got approved. Also my first letters of good moral and witnesses weren't notarized either.

If your affidavits aren't notarised then they aren't affidavits, they are just statements or declarations.

well like I said I got approved! Even though they weren't notarized. I have my lawyer about 4 letters. Even one in Spanish from my mom. I filed in August 2011 got approved Feb. 13. Back ten the waiting time was 16 months. The only RFE they asked for was for proof we started living together right away because my lawyer had only sent in proof for 5 back tracking years and we've been married for 6. The new proof was notarized though. Got approved about 3 week after.

Oh I'm not bashing you or anything, I'm very glad you were approved. I was just pointing out a technicality for others.

My lawyer advised me to get affidavits if I could, statements if I had to. Affidavits are usually preferred, since they are a sworn statement made in front of a notary.

I'm guessing u meant u "gave" lawyer 4 letters. But why didn't lawyer notarize your statement? And what evidence won your abuse case?

my lawyer is a very good lawyer and very expensive. My parents helped me. I have two little kids and had lots of pictures . Recent pictures in fact I still had bruises when I went to see the physiatrist. But I also had letters from his grandpa and stepsister stating good moral and that the marriage was legit. I think I have been very lucky! I had no idea there was such a petition I could apply for sense I didn't have cop reports.

Hi,

Can you please let me know how long ago you submitted you VAWA Petition? I am still waiting on a response and I submitted mine November,2011. I have not received prima facie notice yet.

Mine was 2 3 may be 4 pages not notarized, and 2 letters of moral character with background check.. Both letters were notarised one was from landlord who stated how other tenants complained to him about my situation. It depends on your abuse and extent and how big or small you write.. One thing is certain, the truth speaks for itself and does not need to be convinced.. Write smoothly and freely from beginning to end and all will be well.I got approved 13months with RFE
