No its not. Most of vawa part two ppl had time line or frequently updated ppl on there timeline. It was helpful and reasurring for them

I have another question. Now my Vawa is approved, is it the best time to divorce with my husband, or should I wait after I have my green card in hand? Because I heard a divorce could take 6months - 1year to process especially self-divorce. Please let me know if it matters when I file it.

Apple3013 it don't matter if u start divorce proceeding all io wanna see is the receipt. I think bits Sandra that send me a link but even if u reconcile with the abuser tgsts not a basis to deny you aos once you are honest. An applicant from vawa part 2 "yulissa" reconciled with her husband and went to the aos interview and told them that she did and tgr reason she did. Your vawa was approved because u were abuse not because u still love or don't love your spouse. Thsys not vsc and io problem the problem is to make sure the seven pointers in there requirements were met.

1. Bona fide marriage

2. Abuse

3. Established residence (living together while u were abuse) a lot of people get denied because their police report and their lease or bill dates don't correspond and VCS policy says the abuse must take place while u were both living together in the us or abroad for government officials).

4. Good moral

Can't remember the other three but my lawyer told me.

My affidavit was two pages typed at 12 and lone space 1.5. I told my lawyer that I see ppl have 80 page affidavit. He told me mine was clear cut and I spoke more abt our courtship and intent rather than stress the abuse which they have restrain order, 2 separate police report that explain everything and one when the cops found me with my lips burst up bleeding and bruises on my skin. And pics from one major incident when I was 3 months and two weeks pregnant. He said the fact that he abuse me while I was pregnant will weight my case. I had one affidavit from my best friend Caz she's the only one I confide in. I know my super, security in my building, his sister, his sister best friend or my aunt land lard can give me affidavit Caz they all with ness the abuse to some extent. Didn't want to overwhelmed my adjuncator so I keep it short if they rfe me I still have evidence.

To submit an affidavit with over 13/15 pages is too much.I always recommend 10/12pages maximum, and minimum 7/8 pages.

My attorney filed my I-360 in November,2011. I received RFE in December,2011 - it was for background report. Vermont Service Center received my background report in 02/28/2012. Since then I never received any correspondence in regards to my petition, I have no prima facie note as of today.

Is it possible to take longer because I received a denial on my I-130 September,2010. My ex-husband responded with an appeal to the denial but later he withdrew the appeal.

Howtosurvive vawa unit in several stakeholders conferences made very clear that Vawa based in mental abuse it must contain detailed circunstances of the whole abuse suffered specifying dates as well and mention how the alien felt and reacted to each one of the abuse suffered,descibing how the abuse impacted the alien's life. Having a policial report or restraining order is not enough they put a LOT of weight in the alien affidavit and in the psychological evaluation. We have here One member that her abuser was arrested 4 times,she was hospitalized twice,but she wrote 3 pages and vawa unit said despite the police report and hospital report she did not tell her story and gave her 30 days to emend her affidavit.She contacted me and I drafted 11 pages telling the abuse,after 3 weeks she was approved. It's VERY important to describe in details the whole abused suffered and how the abuse change your well being.I am using my phone, I bet i mispeled some words.

You should've received prima facie for sure. I would advise you contact your attorney and talk to him about that. You can ask him to contact VSC to find out why you did not receive prima facie. In my understanding prima facie is the document showing that your case meets all the criteria to qualify for VAWA. I've never heard that VSC would not issue it for over a year. It is usually issued within a month after filing.

Sandranj is of course right re: length of statement. I wonder if (in howtosurvive's favor) one established (officially documented) instance of physical assault is enough for positive VAWA unit's ruling, even if the victim doesn't testify to mental harm associated with such assault

vawa2013 having a police and/or a restraining order is not sufficient to have a Vawa case approved, the alien must tell Vawa Unit about the abuse suffered as well. As i said before one girl here was battered,stayed in the hospital twice, her husband was arrested 4 times, they asked her to emend her affidavit,because she failed to tell about the abuse in details. We have one girl here in the Vawa thread that her divorce was finalized with base in domestic violence,she had a child with the abuser, she had police report and restraining order, but her Vawa was denied, they said she could not prove domestic violence.She refiled.As you can see to have a Vawa case approved you need to prove a lot of things and to do a lot of thing as well ,such as getting good affidavits from friends, draft an amazing affidavit etc.
