Hi Guys,

Just an update from my side. My Vawa got approved today. The site was updated and its in post decision activity. From the avvo site I gathered it would take somewhere between 60 and 90 days and today was exactly 90 days. The site said that on May 20th, they approved the vawa. I didn't ask my congressman to inquire. Just a recap I filed my vawa on August 27th 2011. I got an Rfe for good moral character on November 2012. On 20th February they received my rfe response. So the first phase is finally over and now the waiting game begins for the second phase: the I485 interview. From the looks of it people have had to resubmit the medical records. Hopefully I will hear soon and maybe God will have some mercy on me and I will get an interview soon. My local office is in Saint Paul so I know they take about 6 months to process an I-485. Hang in there guys.

Does anybody know what is the world genius record for vawa waiting? Am I close to bronze medal? how is the feeling when people got their vawa approved? that must be good, I can smell it by using my imagination. If I miss my vawa, I will have to go for EB-5 business immigration, actually that is half a million dollar deal. Wow, I guess with that amount of money, People can live their decent life anywhere in this world. What I am going to tell my kids from my vawa experience is "No ask No tell". Actually when people really got traumatised, they can ignore pain, just like Jonny English, he knows no FEAR. he knows no DANGER. he knows NOTHING......

Yes, you should be able to file based on INA §204 (a)(1)(B)(v)(II):

Upon the lawful permanent resident spouse or parent becoming or establishing the existence of United States citizenship through naturalization, acquisition of citizenship, or other means, any petition filed with the Immigration and Naturalization Service and pending or approved under clause (ii) or (iii) on behalf of an alien who has been battered or subjected to extreme cruelty shall be deemed reclassified as a petition filed under subparagraph (A) even if the acquisition of citizenship occurs after divorce or termination of parental rights.

You can read about advantage and disadvantage of filing of adjustment of status before approval of the I-360 in this thread. If you know that he is a naturalized citizen now you can do everything like you were married to a citizen.
