ch hope you cannot file I-751 jointly because it's FRAUD! if you don' t live with your husband anymore you cannot file I-751 with him,period. UScis do not care where of with who he is living after the separation, the important thing is to prove you had a bonafide marriage.You have enough proof of bonafide marriage.File for divorce, change your phone number, never more talk with his friends and family, if he shows up in your house call the cops right away. In your divorce papers you don' have to put your address, If you have a restraining order against him.

If you were referred to see a psychiatrist then do it for your well- being.As I said before you can tell Uscis you suffered mental abuse when filing I-751 waiver based in bonafide marriage but do not focus in your letter about mental abuse because it won't be the ground for your I-751waiver, describe the bonafide marriage, how you met him, where,when (use at least 2 page describing courtship), mention if you met his family, friends, if you traveled together,if you spent it holidays with his family,living arrangements etc...then tell how was your marriage , describe when started the abuse, mention some of the abuse, do not use more than 20% of your affidavit stating about the abuse.get at least 3 notarized affidavits from friends stating about bonafide marriage,they should mention date of birth,place of birth, present address and contact number.They should mention when they met you, when, last time they saw you, if they visited you in your house(describe circumstances, dinner?party?)if they met your husband etc.if someone knew about the mental abuse when you were living with him ask the individual to give you an affidavit as well.

Thank you very much Sandranj for your advice, I will file for divorce soon and protection order against him and his sister, and I think that I have to change my place cause i will not be safe staying here after filling, I will go to far state, I hope that what I have so far enough to prove that I enter the marriage in good faith which I really did.

I don't know how I will arrange my life after filling and moving.. that's my worries now. God help me please.

Ch hope if you dont have a place to stay or no money then find a shelter for victims of domestic violence they will shelter you for a while and in the meantime find a pro bono lawyer if you can't afford one and file for divorce right away.Go to the Court and say that you fear for your life,mention he has 3 guns and he treatened you in the past and they will issue a restraining order against him. For everything you said I believe you will be able to prove bonafide marriage.You can get a pro bono lawyer to help you with your I-751.If you decide to file the waiver by yourself feel free to email me to review if you want ok.Remember people here in the thread are not victims they are survivos.They were able to break free from their abusers and regained their power back and you are doing this right now, be proud of yourself.Despite the dark place you are right now in your life believe that there is a different place where soon you will find yourself again, a place called "freedom".

what's your e-mail if you don't mind? and should I file by my immedietly after filling for divorce or should until I get the divorce degree or Dec 2013-Jan 2014?

We were lining together with his mom. Bills and lease was in her name. I send in court documents showing that we went to court re the abuse, affidavits from his sister and friends but they claime the affdavits vague.

I am so depressed because the i485 and the i360 is denied.

So sorry to hear that nep28 whats your next step? Would you appeal?

So my case was sent to my local office about a week ago and now my update says they need evidence for the initial of the case. Anyone know what they might be asking for? Or what that means? It looks to me like its moving pretty fast anyone else have had this before?

Cc1988 Sometimes local offices ask for initial or additional evidence. Local office is not supposed to re‐adjudicate the I‐360, but if they find there is not enough proof of bonafide marriage they can ask for additional evidence, sometimes revocation does happen, but it's not common.

Here is what Vawa Unit said regarding the RFEs.

"We've heard a lot of folks in the field have been receiving RFEs lately for things that they feel they'd addressed in the original I-360 or would not have been required in the past. Is this a training issue or the case of a rogue adjudicator? Can a supervisor review the RFEs?

For the past three years, officers have been required to get any permanent immigration record of the self-petitioner before making decisions on the VAWA application. As a result, some RFEs are generated by apparent conflicts between the self-petition and information about the self-petitioner contained in his or her permanent record. Officers have been encouraged to give specific information in the RFE about any perceived conflicts so that the applicant has an opportunity to meaningfully reply to the request".

The missing teens Amanda Berry, Gina DeJesus and Michelle Knight have been found alive today after 10 years missing,all of them in the same house(they were kidnapped).Charles Ramsey (neighbor) helped to rescue the girls, he is simple man and with his help he changed their story...way to go man.We should never give up hope.
