Hi im planning on filling i360 in the end of the month, I have an apptment with a lawyer, but I can't wait that long, I have too many questions! I have ssn, but my visa expired 4 years ago, I'm married to citizen. How long will I have to wait until I can get work permit? Right now I have no money saved and staying at this place for homeless people... I'm going to dhs next week, can I apply for any benefits right now or will I have to wait till 360 gets approved? Thank you!

MeEe are you in a shelter for homeless people or for victims of domestic violence?.In order to get work permit you must file I-360 along with form I-485 and I-765.? Currently it is taking about 45/60 days for a work permit to be approved, to renew it takes less than 30 days. You cannot apply for any public benefit without receiving a prima facie, you will receive the prima facie after 25/35 days that you submitted your case. Were you battered or did you suffer mental abuse? if your Vawa is based just in mental abuse do not file Vawa without having a psychological evaluation and proof that you attended at least 5/9 therapy sessions ok.

It was mental, emotional, verbal... Right. Is I'm staying at the shelter for homeless, but the first place I went to after I left my husband was this organization for woman with domestic violence, they set the apt with lawyer for me and right now they are tying to find a place for me at there shelter, crossing my fingers that I will get in there next week. So I have to go to an actual therapist? This counselor from the shelter will not work? What about those crisis line places? They gave me a phone number and told me that I can go there and talk to someone in person. Thank you so much Sandra, you just made this waiting much easier for me!

MeEe as i said before Vawa unit requires a psychological evaluation for vawa cases based in mental abuse. Counselor, social workers can just give you a letter stating that you spent it some days/weeks in the shelter or had some couseling sessions, but they do not mention anything besides that, and to be honest with their letter won't help your case, you need a psychologist who states

history of the relationship

end of relationship

onset of problems

treatment recommended

treatment done

tests done (MDD,BDI,GAD

describe history of mental/physical and/or sexual abuse

Diagnostic using AXIS(manual mental disorders)

conclusion.

I handled several cases that the individuals had 5/10 sessions and many of them got RFE asking for the psychologist to inform if the individual is still doing therapy, evolution of the therapy, if the individual was referred to see a physician and numbers of sessions until present.
