Sandra that is a bit disheartening to hear that if one doesn't get divorced then the case will not be approved. I am not divorced and i can't even afford to get a divorce because I am so financially dependent on my husband. If I leave then how will I support myself and my school. Sometimes abused people just get stuck in a rotten situation and to think when one is looking for hope then the guys at VSC think oh that person isn't divorced so we won't approve. Its easy to say use prima facie but my attorney said if I use it then that might be a problem when my i-485 interview comes because they will think i need government support. I have been waiting 16 months and golly I am really hopeless to the point that my mind has stopped working.

Panama-Guy are you still living with your wife? Immigration Law states you can file Vawa when still living in the same house with your spouse,but if you keep a a marital relationship they may not approve your case at all. I saw in many AOS interviews the adjudicators asking "did you get divorced"? some people said "not yet" and explained them why not, others 'yes", and every time someone said not yet they said " file for divorce as soon as possible".I heard that several times.

Find a shelter for victims of domestic violence and stay there, if you think she is not a good mother call the social services or take your child with you and file for custody of your child. You don't have to do DNA test to prove your child is yours for immigration purposes, having your name in the child's birth certificate is enough.

I talked to my lawyer about the divorce and he keep telling me to wait till they approve my vawa ,than start the divorce, I m affraid of filling for divorce start a court fight with her and than they deny my vawa. if they deny my vawa its a big chance they will start deportation procedures than I will loose the chance to have my baby and look after her. if my wife takes the baby she will end up at a goverment facility because she will take her to this drug addcited friends house with her and she dont take care of the baby at all. Only thinking about my baby alone with her it drives me crazy. I would like to wait till my vawa get answered at least, if its approved i will file for divorce next day, so when i go for interview at least i have start the process or maybe already have the divorce papers in hand. Guys I take such a good care of my baby, she is beautiful,she have a beautiful big room only for her, the room is full of all kind of toys,her closet is packed with clothes, she never wear the same clothes twice. I do anything and everything for her. she is so happy and smart, speak 2 languages, english and Spanish and she is only 2 and half years old. I m so afraid of loosing her or somethign happen to her that it freaks me out.

Have you asked your attorney if there is enough evidence of another VAWA case inside your case: abuse of child by your wife?

So rkina i've been thinking about the pros an cons of receiving PF so your lawyer said it can affect your AOS interview because it shows Government dependancy hmmmmmmm such an awkward situation because then why issue the PF then if we cant use it to the full extent. Thank God your lawyer discusses the case with you mines didnt discuss anything with me at all!

I never applyed for public benefits. I renewed my Prima Facie but never used it for anything. I don't know if it can help me in anyway but I make $250.000,00 a year , I give employement to 5 americans citizen and pay personal and company taxes every year. So I wont be a public charge for the government. I just hope that they will approve my case soon, because its affecting my business , I m so concerned lately that I can't concentrade in my work.

I can't accuse her of that, with the baby she just don't care for the baby, she just use the baby against me to keep me with her, supporting her financially so she can party day and night.

My attorney said that Its not a good idea to have the baby involved in this because the goverment may think that the baby is in a home that not health for her and take her away. I don't let her be expose to anything that the mother do, I keep her away, even ignore her calling me names to avoid confrontation around the baby. for the baby the mother is good. She is happy to see her when she sees her, she dont know any better, and o prefer to keep it that way , till i can file for divorce and have my wife removed from our house and change the locks, get restraine order. and start to leave my life with my baby and start a new chapter.

August 10th 2011 - Received NOA's for all 3, fee waivers accepted
August 26th 2011 - Received EAD
Early July 2012 - Re-applied for EAD based on pending I-485
Mid July 2012 - Received NOA for 2nd EAD
August 1st 2012 - Received EAD
Silence for a few more months
October 26th 2012 - I-360 approval
November 19th '12 - Case transferred
May 2013 - Received interview notice

June 2013 - Interview (approved)

Permanent resident since June 2013

I don't know if you have kids. But a real father do anything to protect the kids. when its a girl its even worse, because I know if my wife takes my baby , 99.9% chances are that she will be abused by the crack heads that my wife hang around. Sometimes You have to do what you need to do to protect the kids. And we all know that the law sometimes is blind and don't see a clear picture of the case.

One thing I know I do ANYTHING to protect my baby girl. ONLY A real father or REAL mother knows what I m talking about.

Panama Guy Forget I-360..File I-140 under EB5... you will get approval in 15 days because you can do premium processing and green card in 5 months. many of my friends used EB5 category who runs business .it only required 1 million business and hire 2 american citizens which you already.. ask your lawyer ASAP. believe me file it today... it has waiver for unlawful presence also... Do It....I-140

Panama Guy Forget I-360..File I-140 under EB5... you will get approval in 15 days because you can do premium processing and green card in 5 months. many of my friends used EB5 category who runs business .it only required 1 million business and hire 2 american citizens which you already.. ask your lawyer ASAP. believe me file it today... it has waiver for unlawful presence also... Do It....I-140

The only thing is that my father got the company under his name, he hold a work visa here in the US and live in Panama, because of my marriage problems he didnt put it under my name, and he was afraid that my wife would ask for half of the company at the time of divorce.
