Of course with SSN card+EAD you were fine. I still don't believe howtosurvive's opinion that MA would issue DL in 2013 without at least this combination...

As far as "DL will be expired as workpermit", I'm not sure of DL terminology here. My guess is that DL will show expiry date 5 years forward; however, it will have red inserted line stating "temporary visitor status expires...date 11mo. from now"

Hi everyone. I just went to DMV today and just want to share my experience.

Firstof all, i'm in PA.

I gave the clerk

1-social security card (original)

2-valid passport

3-work permit ( expires in 11 months)

4-proof of residency

As you know i was worried because PA require at least 1year of legal presence.

It turned out to be good. He said i'm good to take written test today and also told me that my Driver's license will be expired as my workperimit.

I didnt even show him the PF. Once i showed him my work permit, he said its enough.

I was worried cuz i knew a lady in PA was sent home cuz she did not have 1year legal presence and she was only short in 20days. And she had all the requirements

The red line on the license doesnt matter to me, im just happy driving with license.

akumu the Immigration Law allows you to adjust status in the USA, it's up t you. It takes longer to adjust status in the Usa instead attending the interview in your home Country.As i said AOS is discretionary it means the adjudicator can use his own discretion or judgment to approve or deny your green card, but if you choose to attend the interview abroad the decision is not discretionary is statutory it means they follow just what is regulated or authorized by Law/statute.But as I said before I could not find anything in the Immigration Law allowing you to receive green card once you got married.

Thats true Sandra.., i decided to adjust my Status over here in U.S which might take time. Its better to have options over here just incase vawa doesnt go through i can have the lottery one incase my parrents get approved. And as i said before i was Unmarried and under 21 years when my dad applied for the greencard lottery. And the Lottery States Unmarried Children under 21 at the time the Applicant entered the DV Lottery.

Maccbook you should file I-360 again and please no more mistakes huh?

-You submitted marriage license, WRONG, you must submit marriage certificate.Marriage license just show you applied to obtain a license to get married not that you got married

-You informed/instructed Vawa Unit to find copy of your wife birth certificate. Did you submit proof showing that you tried to obtain copy of her birth certificate but you could not obtain the copy?. It's not enough to say hey check my petition I-130 and you will find copy of her birth certificate. There is a memorandum from Uscis saying they may search the spouse status if you were UNABLE to find a copy of her birth certificate/status.If you know what State she was born then you are able to get a copy of her birth certificate with the County Record, and of course Uscis will not search for you if you know where to get tho. For example singledad posted here before he didn't know if his wife is a green card holder or a US Citizen then he asked Uscis to search about her status and they will search for sure, but as far I know your ex wife is American then you can get copy of her birth certificate any time you want my dear or not if you have no idea what state she was born,lol

-Affidavits from friends did they mention ALL these things

-how YOU met your wife and where;

-when THEY met your wife first time and how many times they met her and where;

-did they described your relationship before the wedding(happy,excited,nervous etc.);

-did they write down if they attended the wedding and how was it?(religious ceremony followed by a nice party, or it was a simple religious ceremony but romantic, touching etc, or just a civil ceremony and after the ceremony all gathered together for dinner or drinks etc;

-did they describe the wedding atmosphere, how you and your wife were acting(happy,tired,nervous etc..);

-did he/she mention why he/she could not attend the weeding? did he/she send you a gift? a card?;

-did he/she mention in the affidavit about the wedding pictures,;

-did he/she mention about your honeymoon(where,when, if you enjoyed etc...)

-did he/she visit you in your house after the wedding?;

-did you meet her/him in other places with your wife(restaurant,church, coffee place etc.);

-did they describe your relationship with your wife before the wedding? (loving, affectionate,caring etc?);

-did they describe relationship with your wife after the marriage;

ETC.

I am sure not everyone submitted affidavits stating all these things, but if you want to increase your chances to have your vawa approved then you lawyer should consider to do the right thing,lol

For bona fide marriage I submitted 13 affidavits and 11 of them states everything you mention, also i submitted tax return, utility bills, credit card statement. All of that showing both names.

Also they denied my case with out sending me NOID (Notice of intent to deny).

Now I'm thinking of appeal. Whats your opinion on that? Should i appeal it or just refile? Which one will be faster and more favorable?

YOU GUYS are smart to handle your vawa case, although I found my state senators, still no news yet, but I do appreciate their help anyway. maybe I should find some white attorney, who can communicate with VSC using real English language.

Macbook: please donot be emotion, just follow sandraj's advice, you need hand in your marriage certificate with county seal on the back, you can get it in 10 dollars per copy. also you can order your wife's birth certificate from www.vitalcheck.com, it is only 20 dollars. I think your friends are your real friends, they helped you a lot and wrote so many reference letters for you. just gave it another try, you will get it for sure. why not?

I probably donot want to do this again, too time consuming, I got lots of gray hairs from my vawa application, maybe before my vawa is approved, I am already dead meat though. if my wife want to come to Auckland, I will buy her a ticket, she need medical care and drug rehab, although I talked this to VSC N times, seems like I am barking all the way. Please donot put your life on the other people's hands, that is stupid.

Hello my dear friends. Today I got denial letter from VSC and if was not sad situation it would be comic one. Reasons why my petition was denied are;

Section 204(a)(1) of Act, as amended, requires that a self-petitioning spouse must show that he or she:

(1) has a qualifying relationship as the spouse, intended spouse, or former spouse of a citizen or lawful permanent resident of the United States;

(2) is eligible for immigrant classification under section 201(b)(2)(A)(i) of the Act, based on a qualifying relationship with a citizen of the United States; or section 203(a)(2)(A) of the Act, based on a qualifying relationship with a lawful permanent resident of the United States;

(7) entered into the qualifying relationship in good faith.

So I "fail" to proof that

(1) My wife is US citizen

(2) I was eligible for immigrant classification

(7) establish that I entered into the qualifying relationship to the citizen in good faith.

My interview today .. Was for 9:45 took like 5 min

The IO said when I get in the office to say the true .. And he goes u got first part approved so these is just paper.. you have your passport right? Gave pasaport to IO

Very relax asked are you working I said yes, gave him letter from work, and I said I got my taxes From 2012 and passed to him IO put it in my file .. IO said let me go supervisor your approved need him to sign. Then we he got back asked me divorce paper I say yes you wan the paper he said let me put it here ., have a good day wait for your residence within 30 day .. Bye now ... And walk me outside .., easy easy easy .., what u guy think

About yes or not question he says all this is not ... Right.. I say yes everything is not.., .......................,,,,,,,,,,,,

For bona fide marriage I submitted 13 affidavits and 11 of them states everything you mention, also i submitted tax return, utility bills, credit card statement. All of that showing both names.

Also they denied my case with out sending me NOID (Notice of intent to deny).

Now I'm thinking of appeal. Whats your opinion on that? Should i appeal it or just refile? Which one will be faster and more favorable?

USCIS mainly focus on Bonafide marriage based on

-- Joint Checking or Saving account ( Account balance should be higher and there should be monthly activity and old account--- they rejected some application based on 5 dollar balance or 100 dollar balance)

-- Joint Credit Card account ( it should not be Authorized user -- if it is joint mention credit limit and spent money jointly and joint purchases)

-- Joint Income tax return ( it should not be married but filling seperately--- On Joint tax return both spouse signature neccessary otherwise they will deny your application)

-- Joint Insurance policies ( Spouse must listed as beneficiery and it should be 100%)

-- Joint lease agreement

-- Joint car purchase

many factors needed for bonafide marriage..reapply and believe in god..appeals always denied (99% denied rate)..

DOn't appeal , Don't appeal don't appeal if you cannot prove submit marriage certificate.appeal just review of your judgment it was correct or not. Go to refile cause you need buy time and fined what was reason denied you case and find way for solve or alternative way. you can do it ,and mandatory do it. you have not other choice just standing and fiting , never give up
