Singledad2usc they don't go online and you'll see. I got my DL there in 2011 I was well out of status. Neither Rhode island, new Mexico, Washington state, Chicago and one of the Dakota. I read up on it when I wanted a DL.

Hi,

Congrats to every one who had their vawa approved. I have been a regular visitor to the site. Macbook I am sorry to hear about your case. Hopefully things will work out soon.

I am pretty close as well but the wait is so tough on me. My case is in RFE review response and it has been 60 days now but I haven't received a decision yet. they had requested a rfe for

good moral certificate because one of the counties had my name spelled wrong so I had to get police clearances from all the counties with those misspelled names and they all came back clean.

I am wondering if I am at the rfe review process and this is all they requested whether its a good sign or bad sign for my case. My attorney said that its just for qualification purposes and nothing to worry about but I am so worried since its been over 60 days now and no response. I have been waiting since August 2011. As anyone gotten rfe's for only good moral certificate and had their cases approved? would love to know your experiences.

Thank you!

Akumu you said your visa expired but I assume your I-94 is specified D/S right? if yes then you are good.

Here is something to consider the Immigration Law states beneficiary derivatives are entitled to obtain status if unmarried and under 21, but because the Child Status Protection Act provision extends the period considering "aging out" then you won;t have a problem with your age, but there is no provision in the Immigration Law allowing married beneficiary derivative to get GC, even if you were single when your father submitted the DV. If you are eligible (I have doubts) then the good news as a beneficiary derivative of a DV lotery you can can adjust status your status in the USA if you have maintained lawful status since your entry ok, You will be able to submit your AOS when your priority date is current to NBC.Then they will schedule your fingerprints and you must provide proof of paying the diversity visa registration fee.In March 1999 Uscis issued a memorandum to the districts offices to accept AOS under the DV program.

Keep in mind Adjusting status in the USA is discretionary even if you are eligible they may deny for other reasons, but choosing Consular Processing they will consider basically if you are eligible, then AOS is discretionary and Consular processing is statutorily.

you can adjust your status in USA..read here...http://travel.state.gov/pdf/DV_2014_Instructions.pdf

MAY SELECTEES ADJUST THEIR STATUS WITH USCIS?

Yes, provided they are otherwise eligible to adjust status under the terms of Section 245 of the INA, selected

individuals who are physically present in the United States may apply to USCIS for adjustment of status to

permanent resident. Applicants must ensure that USCIS can complete action on their cases, including

processing of any overseas spouse or children under 21 years of age, before September 30, 2014,

since on that date your eligibility for the DV-2014 program expires. No visa numbers for the DV-2014

program will be available after midnight EDT on September 30, 2014, under any circumstances.

akumu the Immigration Law allows you to adjust status in the USA being a diversity lottery derivative beneficiary if you meet DV program requirement.

You said that Immigration told you won't have problem because you got married, well the immigration Law States:

"In order to obtain Lawful Permanent Status, a principal beneficiary and accompanying derivative family members (spouse and unmarried children under 21) must apply for an Immigrant Visa through Consular Processing. Alternatively, DV beneficiaries in the U.S. may apply for Adjustment of Status". As I explained before you are over 21 but you are ok because of the Law protecting who aged out, but the alien must be SINGLE. I believe you do not meet the DV requirement, but you should consult a lawyer specialized in this matter.

They won't give hard time if your parents attend the interview without you.keep in mind winning the lottery does not guarantee issuance of a visa or AOS approval.
