Hey Hypnos..,i am graduating on May this year., my Visa expired but am still in School. I had an infopass today with Immigration Officer and She told me that as long as i wasnt Married when my Father was applying for DV Lottery am good., and i told her i was married a month later and my Visa has expired., She told Me all that Matters is When my Father was Applying for the DV Lottery. So am Just Confused..!! I was told by My Lawyer that i call the Embassy Back at home to know if there is anything that can be done or not. So am planning to call tonyt.

Akumu, it sounds as if you are still in status so do not have any overstay bars to worry about if you left the US.

You should talk to your lawyer about what path to take (remain and wait for VAWA or attend the interview overseas).

Thank you all for the congrats and well wishes. Faith and prayers pay. We can't all be at the same place at the same time, but there are bigger, better plans in all of our futures!

I have a question for 'sandranj' (and anyone else w/the answer)... How long after a vawa approval does one in NYC usually hear word about their pending AOS I-485; where is my file currently since I filed AOS&EAD while vawa was pending, which office's processing times should I check for the status?

do you guys know how long it will take till USCIS schedule your interview after Vawa approval?

My I360 was approved 2/15/13 and my 485 was sent in at the same time my vawa did. And so far it hasn't moved from initial review.

I got a burning question. So I had apply for tanf (temporary assistance for needy family) before I got a job on the basis that my child is a citizen is it a problem if I take it or not? They are going to assist me with my rent Caz my husband which is my child father and the abuser moved out, they were going to give me cash and give the baby medicaid and food stamps. Can I still take it? And what if I start working will it be a problem? Will I be considered a public charge? A lil help would be great even though I found a job. Child care isn't cheap.

10/8/2013 aos interview. .. approved :)

Akumu you said your visa expired but I assume your I-94 is specified D/S right? if yes then you are good.

Here is something to consider the Immigration Law states beneficiary derivatives are entitled to obtain status if unmarried and under 21, but because the Child Status Protection Act provision extends the period considering "aging out" then you won;t have a problem with your age, but there is no provision in the Immigration Law allowing married beneficiary derivative to get GC, even if you were single when your father submitted the DV. If you are eligible (I have doubts) then the good news as a beneficiary derivative of a DV lotery you can can adjust status your status in the USA if you have maintained lawful status since your entry ok, You will be able to submit your AOS when your priority date is current to NBC.Then they will schedule your fingerprints and you must provide proof of paying the diversity visa registration fee.In March 1999 Uscis issued a memorandum to the districts offices to accept AOS under the DV program.

Keep in mind Adjusting status in the USA is discretionary even if you are eligible they may deny for other reasons, but choosing Consular Processing they will consider basically if you are eligible, then AOS is discretionary and Consular processing is statutorily.

Congratulation to everybody who got approval!

Today I got denial email. After waiting almost two years I got DENAIL. now I'm waiting for letter to see why. :crying:
