politics will take forever to make a bill and then Law. we should focus more on I-360 way.. gether more evidences and faith in god . i hope in this forum everyone will get approval for I-360 soon who filled in 2011 and someone like me who filled just last month may be in 2014 or 2015..

I agree with you Indianguyyy that bill will be a number of years in the making before its introduced into law. So for us I-360 is actually a better option its not what we had planned but God knows best I believe God shielded me from mishap with my spouse and he took me down this route I pray for us all to rejoice one day when we become permanent residents!

It's been awhile since I logged on this site. Congratulations to everyone that recently got approved, and good luck to all others, we will all get through this together.

Some of you know my journey. My petition was denied after almost 2 & 1/2 years of waiting. Oh well...I thank God for everything. I am still here and alive, so there is still hope.

I have stopped crying, and my self-pity just has to end, I have a 5 year old daughter to care for. So.. I am ready to refile my petition, this time I want to file for adjustment of status and EAD with my I 360. I only filed the I 360 in 2010. I need to work.

Sandranj can you help me? And others that filed on their own PLEASE help me!

I had a lawyer the last time, but I want to know if I can do all these on my own, or should I still use a lawyer? I don't know if I can afford a lawyer, I am not working.

What applications do I need to file for adjustment and EAD, please walk me through the process PLEASE.

My petition was denied because they questioned my marriage, they siad I met all other requirements but that. I have my original marriage license and other documents now so I am sending all that.

I am sorry your case was denied keep trusting God for your approval he doesnt give us more than we can bear. But I would like to ask I dont mean to pry. Since both you an your spouse share a daughter together what about your case seem suspicious? Did they state why? Seem so unfair!

Thanks sandranj, i sent them a lot of documents, bills, photos, birth certificate of our child, health insurance, etc to prove bonafide marriage/entered into the qualifying relationship in good faith. We lived together for 3 years. I will send you more information.

My marriage did not take place in the United States, thats all. It states that all other requirements were met.

For those filing Vawa based in mental abuse here is my advice find a PSYCHOLOGIST to give you a psychological evaluation. It's important to participate in the meetings that most of shelters provide with a counselor or social worker, but they can't perform a psychological evaluation and vawa Unit wants a psychological evaluation.

Many people email me saying they got RFE and USCIS are asking for psychological evaluation but their counselors or social workers gave them a letter, well the letter won't help at all, then if you were victim of mental abuse or even psychical abuse then find a psychologist ask her to performs tests such as BPI test (The burn depression inventory) BAI(The burn anxiety inventory)and to give you a "multi-axial assessment" ok.

Before submitting form I-360 attend at least 5/6 sessions of therapy and please keep going at least for a few more months after submiting your Vawa case. Last week one person contacted me because she got an RFE asking her to submit proof that she is still in treatment and for the psychologist describe her mental condition evolution until now.Well she stopped going to therapy as soon she sent the papers to USCIS.

Macbook it's not important to have a psychological evaluation but to have a damn good psychological evaluation.I read some evaluations oh man it was garbage.The psychologist wrote 1 or 2 pages stating xxxx was diagnosed with depression and anxiety. #######...the psychologist must tell vawa unit the whole story that you told her and then the psychologist must state onset,findings,diagnose and conclusion.It means 7,10 or 12 pages.If you say the patient suffers Major depression the psychologist has to explain why she believes you have depression, mention if she referred you to see a doctor to start with medication.How you are reacting to therapy,show your evolution with the treatment etc.

Well when my psychologist gave me the sealed report to give to my lawyer it certainly didnt feel like 7-10 pages :~( I hope she gave me a convincing diagnosis. Sandra she wanted me to continue seeing her but I couldnt afford $100.00 a session at the time. Do you think I should see her again for a few sessions?

Faithkeeper if your vawa is based just in mental abuse Then i think you should keep doing some therapy at least once a month, but if you suffered physical abuse as well and have police report and restraining order then you don't have to keep doing therapy. Did she diagnose you with major depression? Or pos traumatic disorder or anxiety? If not the chance to have vawa approve is not good tho.The psychologist must state she believes for all tests done and therapy that you suffered mental abuse.She has to describe how you described yourself before the abuse and how she sees you now.It's important to show that the person does not function properly like before, the quality of life changed after the abuse.The vawa unit needs to see substantial changes in the alien behavior when the evaluation was done,of course people improve with therapy and it's great .They sent RFE to 4 people that contacted me and they asked to describe evolution of the therapy,treatment,number of sessions etc
