If you've ever been out of status at anytime then advise seems to be not to use the Advance Parole because you can be refused entry.

Ok, I see, so people who are out of status and have a green card aplication pending as well as pending vawa but with a valid advance parole, will be refused entry to the US, correct?

State has to correct erroneos criminal record, and state should notify FBI to correct their files as well. But state may take forever to do that; your lawyer has better chances of insisting they do

SingleDad2usc:

"btw, if u were ever arrested on false charges, and even if u have Court's disposition (with original of the seal) - make sure the state has entered such disposition in their record, and FBI doesn't have a (erronious) criminal record for you. Such silly state's error is not easy to correct, and may preclude any immigration application"

Could you explain further? what are you saying about FBI? are you talking about any arrest or what kind...im confused

it's better to "deal with them" on your terms, than if they walk in and do removal. u have to understand that they are always happy (over)use their authority. Of course then u r given court-appointed attorney, and if u have good case the Judge will always side with you and against them. But everything is time-consuming; and if u must deal with them - then at least turn the tables, go to them yourself and insist on getting help for child's sake. For example, they have the authority to assist with housing, and with any respite u may require. U r a DV victim; there are needs in your situation that u can't lucidly recognize

I hope it never get to that. Don't wanna deal with CPS.

Hey I just checked processing time. It's up to Nov, 2011 now. You should have your attorney contacted Vermont service center, and if you don't have an attorney, try to find some pro bono attorney or domestic violence shelter they will help you contact the service center since your case is past processing time.

If you still don't hear from them, have your attorney or domestic violence counselor called your state's Congressman and have your Congressman contact the VSC for you. I've seen it worked on previous cases I've worked on before.

Good luck.

There's no need to give up u r closer to the end compared to beginner like me. You will soon get your approval in the mail or seek congressional help as suggested by a member. I pray you fight the winnable fight to the end. Giving up is for the weak and faint hearted people. May this week bring u good news!

Yes Macbook I agree with 'howtosurvive' the race is not for the swift but for those who can endure to the end. Its a long fight but think of the benefits in the long run dont give up my friend we are all in this together at different stages God knows why some of us have to go through this but I pray its a learning experience for us all. Keep trusting God for good news!!
