Here are the guidelines to qualify for DA:

Guidelines

You may request consideration of deferred action for childhood arrivals if you:

1.Were under the age of 31 as of June 15, 2012;

2.Came to the United States before reaching your 16th birthday;

3.Have continuously resided in the United States since June 15, 2007, up to the present time;

4.Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;

5.Entered without inspection before June 15, 2012, or your lawful immigration status expired as of June 15, 2012;

6.Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and

7.Have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Does Obama's amnesty apply to those who came on K-1 visas, got married but failed to adjust their status and then divorced and ended up illegal?

No. You couldn't have entered the US being legally free to marry and being under the age of 16 at the same time(unless with consent from legal guardians). Odds are you entered AFTER you turned 18 when arriving on a K1 visa. VAWA and being a widow are the only exceptions when the original petitioner isn't involved in the AOS.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

If you came on a K1 there is and didn't adjust prior to divorce there is little chance of adjusting in the US. Claiming abuse long after a divorce is unlikely to work unless there is documentation of it during the marrage. False claim of abuse is fraud and will lead to a ban. How long did your marriage last ? If your ex withheld filing to control you , there are cases where the fact you met the requirements of the K1 ( arrived and married in 90 days) open a window for adjustment if you have proof of good faith.

This will not be over quickly. You will not enjoy this.

^^^ read the post before it was deleted.. how can it constitute as violating the rules on this forum when the advise given was perfectly legal and being done left and right here.. hopefully the mod doesn't delete this post as well.. in 3, 2 ,1.....

Thank you..... OP asked and researching ways that cannot be condoned I think marriage was a very short time as stated in previous post.
