K-2 Visa - does child get an SSN?

Hi,

My wife's daughter is on a K-2 Visa. She's 5 years old. I called the local SS office and they said she cannot get a SS # until she's eligible to work. This doesn't sound right. Does anyone know?

Yes and no.....K-2s must wait until they have their EAD or GC and then can apply for a SSN. My 5 yr step son had to wait until he got his GC and then we went and got his SSN. No problem.

Only the K-1 visa holder can obtain a SSN within a couple of weeks of POE>

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

That was our experience as well. My wife got hers after a 6 week delay by the Customs and "Burro" Patrol to input her I-94 info into their database. My 19 yo stepson just got his EAD and I taxied him down to the SSA office. He was able to apply for an SSN, otherwise he would have to wait for his 2 year conditional GC to apply for his SSN.

It is not entirely true. She cannot get an SSN until she has a green card. Which would make her eligible to work if she were not 5 years old. :lol:

K-2s wait for the green card or EAD. K-1s can get it right away as some states require an SSN (or used to) for a marriage license.

For EAD, can you get EAD for a 5 year old?

Sure can. Why?

For a 5 year old I would file the AOS for the green card and an I-131 for an Advanced Parole IF you thought they may travel internationally before they get the green card. Otherwise just do the AOS. You can go to the SS office and get a letter stating that the child is "not eligible at this time" for an SSN and that will take care of any other need the child would have for an SSN, I did this for the older of our 2 sons so he could get a drivers license. The younger sn was 13 and did not need an EAD so I never filed for one. I did file for the AP's which actually arrived after the green cards. :whistle: It happens sometimes.
