Help! My husband has No W2 or US Tax returns

Filed them today.Nothing owed! All was completed correctly by us so the legal Tax Advisor just had to check it over so nothing had been missed out. Original and copies stamped and submitted by local IRS.

Great progress! Way to be proactive!

Sorry for bumping up this post, but it's the most relevant topic I could find to my situation. Maybe someone can help?

How do I file form I-864 if I am unemployed and have no previous tax returns?

I'm filing on behalf of my spouse. I'm currently unemployed with technically $0 income. I'm 21 years old and I studied abroad from 18-20 years (working part time concurrently). I returned to the US last year, and only worked for 6 months. Since then, I have been unemployed. I have never filed a tax return in the United States. I don't know how to access my W2's from my very brief employment. How do I explain this to the USCIS and fill out form I-864? I am planning to have a joint sponsor in order to prove I can support my spouse. I'm just concerned about my lack of tax reports.

I got to section 6 on the i-864:

Question# 22. I am currently unemployed since 03/2012.

23. My current annual income is $0.00.

24. Income I'm using from any other member of my household - None.

When I get to question 24 d) and e) ask about the person listed above filing a completed i-864a, but I don't need to check either box because I answered 'none,' right?

then question 25 - federal income tax return information is currently completely blank because I cannot fill it out. I have not reported my income for any of the last 3 years :/

I don't know how to deal with this as my husband (US Citizen) lived with me in England as a resident and worked and filed taxes there. We moved to US in june 2012. We submitted all documents .1-130,1-765,I-864 & I-485. I also had my Biometric testing in Oct. I received a Request for Initial Evidence 10 days ago,saying :Submit a Complete Federal Income Tax Return submitted to the Internal Revenue Services ( IRS) from the (petioner/sponsor on form I-864, Afadavit of support,for the most recent Tax Year.

However as my husband paid taxes in the UK and didn't know he had or knew how to file a a US Tax return whilst a residence in England.

Is there anyone who knows how to deal with this ?

I understand that he has to complete a 1040 and a 2555-EZ. But don't know how to complete it.Even if he submits it , it can take up to 6 weeks to process.

We have already paid out $2500+ . We own our house here in the US outright, My husband has a full time job .

Due to the raising living expenses I need to get my work permit as soon as possible so I can start working and help with the finances.

Will my work permit continue to be processed even if the other documents are on hold? My I-765 was registered on Oct 04-2012.

I had the exact same RFE and similar situation. Here is the solution that I figured out that worked. I had my 2011 taxes prepared (1040ez) right when I received the RFE. I submitted them IN PERSON at the local IRS office. I brought a duplicate copy of the 1040EZ that I had the IRS "Time Stamp" to show that they had been submitted. I sent a photocopy of the time stamped copy to USCIS. This is the only way to prove that you have submitted the Tax Return to the IRS without waiting for Tax Transcripts, which take months after filing.

After USCIS received this, my status went to "RFE Response Review" and then the I-765 was approved and an Interview Scheduled. So, I think it solved the issue as far as I can tell.

PS When I did this a month ago, I was the only person in the IRS office. Come January 1st, I doubt this will be the case, so if you can get in there Monday, it might be best.

To answer your question, make sure you were not required to file. If you were, file back taxes. If not, you can provide a statement to USCIS explaining that under penalty of perjury you were not required to file and why. You list your current income on the I-864 (even if 0, USC spouse always supplies the I-864) & then you will need a cosponsor.

10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

Deadline: Feb 9 2013, husband's status expires

TO DO:

- Receive W-2 forms from employers in past year (not sure when they will arrive..)

- Back-file taxes for past 3 years (two of which were overseas) - whether I E-file or use snail mail, no idea how long it will take...

- get a receipt or tax transcript proving I have indeed filed?

Basically as of right now, I cannot provide the required proof for our I-864. I have not filed taxes for the past 3 years and I don't have a just reason as to why not. I don't have my W-2's on file so I have to wait for copies to arrives to be able to back-file in the first place. AND then I don't know how long it will take to process my returns so I can include a copy of my return for the past year, as required by USCIS on the I-864.

One month is all we have - impossible.. right?

Not really, as usually any overstay is forgiven when the greencard is approved.

Bear that in mind, if'n you need more time to get stuff done with the IRS or employers.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Date Stamped copies of 3 X tax-returns going back 3 years for at your local IRS office are sufficient proof of filing your taxes. Make 3 copies and have them all stamped. 1 for your own records/1 for IRS to send off/1 for filing with your I-864.

I am with filing online with an electronic filing system, with the receipt online. Won't that work in lieu of a transcript from IRS or IRS office hand delivered time stamp.....
