K1 Visa Denied In Lagos

Even though I may continue to proceed with their suggestion I intend to keep alive the old petition.

Not sure why they can't just say "Hey good buddy, maybe we called this one too fast, why don't yah all come on by and lets chew on this for a bit and see if we can't figure something out".

My coworkers are all upset (they were hoping they would be done with hearing my special ring tone for my baby when she calls in the office, now they have to listen to it for another 9 months or so rofl.gif) I have 11 of them ready to sign sworn affidavits that they are aware of my relationship with her cool.gif

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

And just for the freakin' record...I'd have those affidavits...all 11 of them, FRONT LOADED with my I-130 petition and pictures of your wedding day! :angry: Sad you were both treated like this! I wish you the best going forward. I know you...you always have a plan! :D

In retrospect I wasted time with K1. I wished that I had studied more on the key differences between K1 and C/IR1.

Another poster who was denied wrote that it feels like screaming at the wind and bashing ones head on the wall and that's exactly how I felt.

No jury in a court of law will look at the totality of our records and evidence and conclude that we did not prove a bona fide relationship beyong the shadow of a doubt. Which is actually what the rule says.

I know if we were British or Australians or Canadians I would just be stressing over buying her a plane ticket now instread of me now stressing over going to marry in a country that I left 26 years ago.

I still like the K1's though. Knowing all the in's and out's and pro's and con's I am still contemplating refiling the K1 and not the CR1

to save the expense of getting married now, I rather AOS later. Haven't decided yet.....just pissed enough to join the class action perhaps.

Good if you have the funds/time to jump on a plane and marry but it is not yet in the making for me unfortunately.

I still like the K1's though. Knowing all the in's and out's and pro's and con's I am still contemplating refiling the K1 and not the CR1

to save the expense of getting married now, I rather AOS later. Haven't decided yet.....just pissed enough to join the class action perhaps.

Good if you have the funds/time to jump on a plane and marry but it is not yet in the making for me unfortunately.

I spent a tidy sum on the K1 process (getting Passport took a big part because we had to do a name correction).

I just have to get this done as it's about integrity in my case and I hate the feeling that I get at night thinking that I am abandoning my Fiancee in Nigeria especially since we were so close.

I was finally able to speak to the immigration liason at both Senator Boxer and Feinsteins office.

They both said they were unable to help me since the visa was already denied. Boxers Lady person was curt and absolutely of no feeling. Feinsteins Guy was a bit more understanding (sounded like he has a foreign ascent) adn will actually call the embassy but he said there was no hope.

So to those who were able to get their Senators to act on their behalf on here (I've read of a few), kudos to you and your Senators who seems to actually care about their constituents.

I will remember this during the next elections :thumbs:

I have a senator fighting and a representative with claws and fangs fighting like its her own fight. She is even scaring me :blush: .Not that there are guarantees, it would be a miracle if we were reaffirmed. Just killing time anyway until my piggy bank is full enough.

I also have no Congressperson until January 2013.

Keep contacting your constituent US congressman/woman about this issue if he/she is strong enough there will be a response to your case. How if ever you want to re-file please let the US congressman/woman be involved. That's what i did and my fiancee got her visa.
