OMG! Gowon, I was holding my breath when i read ur very first post....so sorry. Try what someone suggested about contacting a senator ASAP and see how that goes. Remain strong and it will work out.

12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

So you Guys are right. Of course no0pb.gif

My concern now is that since I won't be able to rebut the allegation, will we have a marker against us now for future visas?

My concern now is that since I won't be able to rebut the allegation, will we have a marker against us now for future visas?

Naw it will just come up "I see you filed for K1 before" she will explain yes you denied us cuz you thought our relationship wasn;t bonafide. For some reason its like they want to let people marinate awhile longer. I mean if you weren't real why deny than approve the second time.

Hey run over to 9ja marry at registry and file. You'll have your Queen home by spring time. :)

No it shouldn't, I was denied a K-1 before, and I got married immediately after my interview....... During my CR-1 interview, the CO said she notice I was here on a K-1 before and I was denied based so so reason, I was like yeah that's the reason and she was okay with it...... Sometimes they don't even bring up that question.....

No, unless you receive a NOID/NOIR and don't respond to it. When they let the visa expire it has a "soft" marker that is

disregarded with your next petition. UNLESS it is material misrepresentation, then it is a "hard" marker. Their version of lack of bona fide bears no hard marker UNLESS a NOID/NOIR letter (which you won't receive) is not responded to.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
