questions about AOS procedures

OK, so my husband and i recently got married on OCt21.

Should we go apply for his SSN now and hold off on sending the AOS packet til he receives it?

As for the affidavit, it's just him and me in the household now, so i would need $18,912 in income, such as income from a current job plus a savings acct balance? I had been living with my parents till now so I always let them claim my exemption on their tax return, but i do have a small income tax return, How should I go about this??

Submit my small tax return, plus Statements of fact for my bank accounts and my most recent pay stubs?

As far as saved up money i only have about a little over 10k, meaning i would need about 17k in assets if i wanted to try sponsoring my husband by myself??

Any help or advice is really really appreciated, I've been stressing myself out over this, think I see a few wrinkles making their debut.... :help:

December 16 2011 Received first NOA which was sent December 15

April 16 received second NOA.

May 14 received letter from American Consulate General

May 18 sent packet to fiance

June 20 fiance finally received it (postal ppl had it there since beginning of june, but told him they didnt)

july 30 They issued his Visa :)

September 6 arrived in Texas

October 21 got married :)

You can file the AOS without his SS card. Can you get your parents to be co-sponsors?

If I were him I would go ahead and apply for the SSN now, because once his I-94 expires he won't be able to apply for one until he receives his EAD. Having a SSN is useful in many ways. Actually he needs to apply at least 2 weeks before his I-94 expires.

However he doesn't have to wait to receive the SSN before he applies for AOS. It's not needed for the application.

Well the only thing about having them as co-sponsors is that i dont know if they'd cover the 125% , since in the household for them including my husband and i would be 5 people. But ok , my parents AGI for 2011 was 46k, does that mean they would cover the full amount with that? and i know as far as assets they have alot more than the 33,762 required for a 5 person household. so, that plus any other supporting evidence would suffice? 2011, 2010, 2009 tax returns + statements of fact for bank accounts + asset info for them + all of my info. Or is there anything else we should include.

And ok, we'll go apply for his SSN hopefully sometime this week :)

A few questions: Do you currently earn enough income for a household of 2? How long have you been at your current job?

What you are making currently is important and can be proven with a letter from your employer and recent pay stubs. If you currently earn enough, you may be fine. If you do not make $18.912, then you can use liquid assets that are 3 times the amount you are short. For example, if you make $17k but need $19k, then you need 3 times the $2k you are short. Your $10k in savings would cover that.

If you use your parents as joint sponsors, then they would need a current income of $33,762 for a household of 5. http://www.uscis.gov/files/form/i-864p.pdf

You said they made $46k last year. What do they currently make? Does one parent earn at least $33,762 on their own? Is anyone self-employed?

You will fill out an I-864 and provide most recent tax transcript, letter from employer and recent pay stubs (bank statements to show savings if you need to use assets). If you need a joint sponsor, then one parent, the head of the household, fills out their own separate I-864. They also provide their most recent tax transcript, letter from employer and recent pay stubs, plus proof of being a US citizen or permanent resident. if that parent does not make enough on their own, then the other parent can fill out an I-864A as a household member to combine their income with their spouse's to reach the 125% requirement. They also provide all the documents as the first parent.

It will help to know the answers to some of the questions I asked. Also, you should read through the instructions for the I-864 for all the details of what is required and what you need to provide.

well, been at my job only since aug 20th, gross pay every 2 weeks is 818.50.

My dad is on Social Security Disability, well retirement from his job, so he makes the same every year.But my parents have joint accounts on everything, but, i'll finish answering questions a little later, i have to hurry to work, my work schedule is killing me lol. thanks for everyones help and responses so far :)

Well, you do make enough for a household of 2. It is possible the person processing your case would accept your income without a joint sponsor. However, since you have only been working less than 3 months, they may not. It would depend on the discretion of whoever was deciding your case. So, I think you should go ahead and ask your father to be the joint sponsor just to play it safe and avoid an RFE that would slow down your case.

If your father makes $46k on his own each year, then no need for your mother to fill out an I-864A. She would only need to do that if her income was needed to be combined with your father's to meet the 125% requirement. You fill out your own I-864 and provide your 2011 tax transcript, employment letter and recent pay stubs. Have your father fill out his own I-864 and provide his most recent tax return, proof of his disability and retirement pay and his 1099(s) to show his individual income. Also make sure he includes a copy of his birth certificate, naturalization, bio page of US passport or front and back copy of green card to prove he is a USC or LPR.
