The father is the usc. Actually we were married now. Our wedding was postponed due to early labor and delivery and complications during pregnancy. It was 2 weeks after my delivery

The rules seem quite clear here, what exactly is your question? http://canada.usembassy.gov/consular_services/birth-abroad.html

Thanks penguin..

I read that rules but my question was:

1. Does my child considered to be USC by birth out of wedlock? Because we were not married yet when she was born... So if this is the case we have to provide an evidence as stated: A blood relationship between the person and the father is established by clear and convincing evidence;

2. Or does she considered to be a USC by birth in wedlock because we as her parents were married only after her birth? If this her case we dont need a DNA test , marriage certificate will do.

1. Yes, assuming the father meets the physical presence requirements. Depending on where you are from, proof that you and the father were together around the time of conception (credit card statements, plane tickets etc) is likely enough, though a DNA test may be requested by the embassy.

2. She was born out of wedlock.
