Hello all,

I arrived at the US last month through K-1 and just married two weeks ago. I know it is about time to apply for the green card. I have a few questions about filling out different applications. Hope someone could shed some lights on them, may thanks!

1. As my certified copy of married license stated that my family name would follow my hushand's one and my original family name would become my middle name. So, when filling the i-485 form and other relevant forms such as I-765, G-325a,I-131, should I use the new legal name from now on?

2. does the "non-immigrant visa number" on i-485 form refer to the control number on my K1 visa?

3. Since some of the forms ask for SSN number, does that mean I must apply SSN asap now before sending the application of i-485?

3. about I-131 form, is it ok to apply it for "just in case for emergency"? I wanna apply it to play safe, in case i need to fly back to my home town suddenly. If yes, when filling in Part 7, do I just make up a intended travel date and period? And would you tick one or multiple trips? And what should be the appropriate reason to explain how I should qualify in the supporting letter?

1-Not sure what youre talking about here. Everyone does different things when they get married. Some people hyphenate their names, others just assume their husbands last name. For example Mary Jones marries John Smith. She can remain Mary Jones. Or she can change her name to Mary Smith. Or she can change her name to Mary Jones-Smith (with or with out the hyphen). The choice is YOURS. Its not up to what was printed on your marriage certificate or what the people in the office who printed it told you. You take the marriage certificate to your local SS office and obtain a new (or first SS card if you dont have one) in the name of your choosing, based on that certificate. And you submit the forms to INS with the name you want to appear on your GC, whether its yur maiden name, hyphenated name, or husbands last name.

2-Im skipping 2, because I dont remember off the top of my head, but I know someone else will answer :)

3-If you dont have a SS# you dont need it to apply.

4-AP takes several months to be approved (just like the EAD) Almost everybody applies for it along with the 485 because the fee is waived and you dont know what the future holds. So yeah, make up a date and time period and check for multiple trips because you dont know how long your 485 will be pending for (it could take up to a year). If you need a reason check the ucis site for valid ap reasons and find one that fits. (almost all immigrants have valid business they left unfinished back home, whether its real estate, bank accounts, elderly family, etc)

Thanks for the reply.

Yeah, I meant if I should put my new legal bride name (the one printed on the certified copy of my marriage license) on all the related forms for AOS application. I suppose I should use it unless the forms specifially require me to put my name at birth.

By the way,today i went to apply for the SSN. So, I put my husband surname on the form as my new legal family name. The staff said the respective depart/office doesn't know I am married. So I passed her a certified copy of my marriage license.

The staff made a photocopy copy for my marriage license certified copy and said they would need to verify my marital status with respective dept. first before confirming my SSN application.

I feel regret - I should have just used my name at birth on this SSN application.

Honestly, it doesn't make sense to me as I am now married and it is right for me to use my new legal name. Hopefully, my application would still be successful becoz my certified copy of marriage license is a strong evidence. I just hope the waiting time would be too long.

Like I said before if you were Mary Jones and your husband is John Smith and you wish to be Mary Smith now that you are married, then you did the right thing.

It will take about 2-3 weeks for you to receive your SS card in the mail.

When you fill out your 485 forms you should fill them out with the name you want to appear on your GC (Mary Smith). The only places you fill in your maiden name (Mary Jones) is where is dictates so. (Enter name on visa here, name at birth, other names used, etc) But at the top of the form you would put Mary Smith.

Your SSN needs to match your GC, so you did the right thing. It is very common for SSA to have to verify information with USCIS. It will be fine.

4. Yes, just put unknown at this time or something similar. Choose "more than one trip". Explain your reason (in case of emergency travel) in your letter.

Use the name you will legally use from now on. If that is your new married name, then use it.

No. You do not have to have your SSN to file for AOS.

Put 'Unknown' for the travel date questions. Check more than one trip. You do not need a reason for wanting AP. No need for a letter of explanation when filing with an I-485.
