Is there anybody can give an advice or to clarify info to fill up a form I -130 section C-17. List husband/wife and all children of your relative?

Since i am the petitioner and i am petitioning my wife and my biological daughter and i have a step son, do i need to enter my stepson's particulars even i am not petitioning him at this time?

In short, i am petitioning my wife and my daughter only. Please advice me. Thank you.

What i mean is, since this form i-130 petition to file for my wife and child, and under child category, my stepson is also includes here. So what will i do to inform the uscis that i am not petitioning yet my stepson.

It wants you to list the husband/wife and children of your relative. So you are listing your wife's husband (you), her daughter and her son. They will understand who you are petitioning for because each person requires a seperate I-130 petition. Your step-son would require you to fill out a seperate I-130 petition for him and send it with his mother's if you were petitioning for him.

If you are a USC you do not need a petition for your daughter and should have/should be filing for herregistration of birth abroad. I'm not sure why you would choose to petition for her instead of just claiming her right to being a USC because she is the daughter of one. But maybe I'm missing something.

Nikir thank you for that interesting question. Thats one thing i have to discuss next. Thats One thing that we didnt do yet is the registration of birth where my child was born. And we are still looking for clarification on this before we finalize my petition . My daughter was born before our wedding. Wedding was postponed due to early labor and so we reset the wedding 2 weeks after the delivery of our daughter. So in short she was born out of wedlock. And that what confuses us if we still proceed to birth registration at the nearest consulate where she was born.

Please be advised and i appreciate your response a lot.

Reporting a child birth abroad out of wedlock requirements.

Is there anybody had an experience to register/report your child birth abroad where the child was born?

I have procedures & requirements in particular documents to be presented for a child in wedlock so i know that thing. In contrary i do not have an exact written requirements by the uS consulate for a child birth to report out of wedlock. Please do advise me. Thank you.

You may need to take more steps but your wife's closest consulate should hopefully be able to help you guys figure out the exact steps you need. I think by already registering your daughter and having your name on the birth certificate helps. It might be something you want to check with a good lawyer about though as well.
