What is a SME? That response you posted is the most useful answer to the OPs question. I didn't know you can claim somebody as dependent prior coming over to US. By the way, I'm not saying the other response are not useful.

Here's what my wife and I did.

She went to the US Embassy on an ACS appointment, and had her bio page of her passport notarized there (50 bucks)

then she signed the W-7 and 1040, along with a letter that stated we both wanted her to be declared a resident for tax purposes, sent all to me via fast post.

I then signed all the forms, sent all to the W-7 address listed in the instructions.

Got a check back 3 months later, along with an ITIN for my wife.

I concur with the above. Make sure you bring the original passport along with the copy to the embassy/consulate so that they can verify the copy. Form 1040 is the US income tax return form. Form W-7 is the Application for IRS Individual Taxpayer Identification Number. This IRS Individual Taxpayer Identification Number (ITIN) must be obtained by those not eligible for a US Social Security Number. If you are eligible for or already have a SSN, then you cannot obtain an ITIN.

your husband cannot add you as dependent in his IRS until you get in USA. And besides you still need SSN before he could file.

Remember, if you are not prepared to file by April 15th, you can get file form 4868 for an automatic extension until October 15. You just have to pay any tax due by April 15, with the extension form, if you believe you owe any. Of course if you overpay, you can get it back as a refund.

I know. It's the 'straight path' for filing 'married filing jointly' when the foreign spouse lives outside of the USA.
