Can't we just get married?

Neither of us are too keen on having to wait for a fiance visa, then a spousal visa.

Can we just get married when he flys back out here and immediately apply for a K3?

All of this paperwork is so complicated:(

You do not need a fiance visa - but it is my impression that that visa is currently being processed faster than any of the others.

That being said - it is legal to get married in the U.S., but he may have trouble convincing the Border guards that he will be leaving again. He is not allowed to come to marry you with the intent to stay and process the papers in the U.S.

But you don't have to do both, if you get a K1, then he can Adjust status after the wedding.

Read through the options so you can make an educated decision. For example, if you marry while he is in the US visiting you, he will then have to leave and wait in his country until his petition and visa are processed. For this reason, some people chose to go the Fiance visa route so they won't be separated after marriage. Depending on where you live, there may be other options as well.

If you look at the Immigration Timelines you can get an idea of how long it is taking. It would probably be reasonable to expect about 6 months, maybe a little less, maybe more.

I married on a tourist visa, my AOs took only 70 days. What can't happen is for them to think that you came here on a non immigrant visa (such as a tourist visa) with THE INTENTION to get married. I came here just to visit my boyfriend at the time, and he proposed while I was here. I did not have to go back to my homecountry during the AOS process.

I married on a tourist visa, my AOs took only 70 days. What can't happen is for them to think that you came here on a non immigrant visa (such as a tourist visa) with THE INTENTION to get married. I came here just to visit my boyfriend at the time, and he proposed while I was here. I did not have to go back to my homecountry during the AOS process.

Great that it worked out for you but not an option for them - he would have intent to immigrate since they are now planning to get married. He'd end up having to go home after the marriage and wait for the K3 or CR1

Yes, you have to play by the rules, just like the other people who just want to "have a life together". That's the harsh and unpleasant reality of it. If you look at the timelines for the UK, K-1 (applying for a fiance visa and then getting married) takes about as long as a K-3 (getting married, and then filing for the visa). And you're lucky; the UK is one of the more relatively easy consulates to get through provided you have an honest and straightforward case. Read the forums here, ask lots of questions, and it'll be as quick and painless as it can possibly be made.

If you want to be together quicker, a fiancee visa to the UK is faster. If you want to live in the UK for a few years, then you can just do DCF from there later.

You appear to have some kind of mis-understanding - normally a person would not need to apply for both a fiance(e) visa and afterward a spousal visa. Normally a person needs only one or the other.

If the VJ Guides haven't helped you, and the information on the USCIS web site hasn't helped you, then have a consultation with an immigration attorney to explain things to you. The fee for a half-hour consultation will probably be less than the fee for any of the numerous petitions and applications that you and your fiance will be submitting.
