How long after we get married will my fiance have to wait before she can work here in the states? (also, if you're military, i have a question)

I've wondered about this for a while. Lets say she comes here and we get married within the first week (just a small court house wedding, we'll do a ceremony with family in Poland in the future) What will be the steps for her to get permission to work, and how long does this process usually take? I'm a citizen, if it matters.

As for the military part, will we be able to enroll her in Deers and start collecting BAH as with any new marriage, or will this be a little more drawn out?

Time Line:

April 13th 2012 Vermont Service Center received our application. (e-notification)
April 20th NoA1 received in mail.
October 17th 2012 Our petition was accepted (e-notification)
October 25th 2012 NoA2 received in mail. (Two actually, one dated the 17th one dated the 18th?)
November 5th Fiancee in Poland received packet from US Embassy in Warsaw, Poland.
November 7th Fiancee filled what needed to be filled out and sent the packet out
Late November: Medical exam, I sent her a packet with things she needed from me for the Interview
December 4th Jaga had her interview in Warsaw Poland! We got the visa :D
December 9th jaga picked up her visa in Bielsko-Biała :)

umm... havent updated this but she has her green card, us drivers license, and is in the process of getting her masters degree recognized here in the us.

Got my answer for part 1 of my topic, sorry about that.

"The K-1 visa does not authorize the beneficiary to work in the United States. The beneficiary would have to apply for AND receive permission to work in the United States. This is authorization is granted as an Employment Authorization Document (EAD). The application for authorization is accomplished by filing USCIS Form I-765.

Your Fiance can apply for the EAD [and Advance Parole] at the same time he applies for Adjustment of Status, which is done AFTER getting married. There is no cost for the USCIS Form I-765 application if done in that order. However, if he applies for the EAD before applying for the Adjustment of Status there will be a fee and the authorization will only be valid as long as the I-94 on which it would be based. "

Part two, the military question is still up in the air though.

You can enroll her into DEERS as soon as you have your marriage certificate in your hands.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Good to see somebody from Lejeune ;) Is your fiance coming to NC? Good luck on your journey.. At the end it's not that bad. We went through the K1 visa process..(in Poland) and now we are dealing with AOS (here in Jacksonville). If you have any questions let me know!

Will an out of country marriage certificate work for enrollment in DEERS?

reason I am asking (about to create a post on this as well) is I am weighing the options on bringing my fiance over through I-129F/K-1 option or go ahead and get married in Canada (she's of course Canadian) and going the spouse route.

About the bah , I'm not quiet sure if u can collect bah right away after marriage bcoz I have some friends get married and didn't collected bah till later on. They said according to the rules of bah you need to be at least living together as married couple with in 6 months at the same house before they granted you that. I'm not sure but that's what they told them most of them .

And yes marriage cert. from other country is acceptable in deers.

BAH granted at the same time. There is no requirement tp be married for a set amount of time or living together for a set amount of time.

When i married my wife in the PI i couldnt get the marrried rate BAH because i couldnt get her enrolled into DEERS at my base (they needed her passport and marriage certificate). Once she arrived to the US, i got her enrolled into DEERS and got my command sponsorship letter from the MPF (i was stationed in alaska at the time so this step was needed). I took that letter to finance and then got my BAH changed. It was retroactive to the date of marriage, which was about 9 months of backpay for it.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

You would have to talk to the personnel office and finance not the family readiness officer.

If the couple is together in the US when married they can collect BAH right after they get the marriage certificate. It will take a little bit for it to be updated. There is no difference between branches on this as far as i know. I have been in the Air Force for 17 years and been through this process twice. It didnt very much for either time. I also have friends at other bases and other branches of service that had similar experience with this.

If someone doesnt collect BAH shortly after marriage, they arent doing what they need to do or ask the right questions. There is no minimum time you have to live with your spouse to get paid the with dependent rate for BAH. You only have to be living in the same house.

Now if you are talking about on base housing, there is normally a waiting list, but not a requirement to be married for a period of time. That is totallu different and you dont get paid BAH unless it is contract housing.
