Hello VJ members!!! I have a friend who's been married for 3 years and he has already received his 2 year green card which has expired.

He has already submitted all the paperwork to file for the permanent green card. He has already one Bio metrics and immigration has already received the paperwork and has gotten permission to travel outside the U.S legally. His wife has threatened to go to the embassy and sign petition to stop the paperwork. They have a 7 month old child together now. Please help with any info. He is is worried that he will be deported. Can she do this?

He submitted the I-751 before his card expired yes? He has the receipt extension? The original letter?

Yes of course she can withdraw her support of the I-751. It doesn't make him deportable, but they WILL make him change his petition to a waiver filing. If she's threatening this I assume they're headed for divorce? If so, file for divorce, and change it to a waiver filing. Not going to hurt him as long as he has all the relationship evidence.
