*** Moving from K1 fiance visa to Effects of Major changes ***

You need a divorce lawyer with local/ state experience, not an immigration lawyer. Ask around locally.

here are the fact:

I am canadian citizen, married to u.s spouse in 2011 oct for a little over 1 year no

met 3.5 years ago. dated, fell in love and got married/ In front of a reverend in n.j. No big function, just us to save $

-she fell sick due to high stress job and had symptoms similar to M.S, still undiagnosed. we have hospital records when we spent the night there togather.

-since then things have soured, intimacy died and her stress level and mood swings got worse. (she has always been on antidepressants her entire life)the intimacy got worse and so did the relationship. loud arguments on her end and i always treid to stay calm and speak logically and lovingly. she has a temper problem. color full language. over the last summer she accused me of having a fling with a client of mine simply becasue we were had a very good work rapport and also had things in common and generally spoke on a frendly basis. My wife to this day still dosent believe me. On top of that she sent an email to my client asking her to be a friend on a social medium. my client knew my situation and unfortunately terminated our contract on email.

then things became worse off as everytime i would say the slightest of my emotions and on how i want to work and the what i feel she would blow up. that set a pattern and i withdrew more and more emotionally. Till this day when we try and talk her anger takes over her and we dont et anywhere.

I have moved out 2 months ago and renting else where now.

- she has written nasty letter to immigration for the past 3 months that i have had an affair, not lived with her and not been intimate.

What we have togather:

1. joint bank account with tons of activity. dinners, entertainment, few months of health insurance, few months of cell phone bill, checques to see a therapist whihc she refused to go to after the first session. I still go to another therapist to find peace within myself.

2. records of a joint trip on our honey moon within u.s.a.

3. joint vehicle insurance and she is the titale onwer. i bought it myself

4. hospital records when she was sick and i was the er contact

5. life insurance policy i took out 2 months ago and she is the beneficiary

6. a joint credit card i took out so she could visit her parents and rent a car. she has bad credit and always had. she alos bfore the wedding , a year before the wedding took my last name to evade creditors and an ex bf that was stalking her. i was fine with that as we were in love then!

7. we have some pics of us togather mostly, very few with others. because she has always been the one taking pics of me

8: i have a letter from my allergist stating that i cannot live in a house with cats as i got increasingly worse. She will not compromise on that either.

problem: she is calling me a cheater, non intimate husband and not wanting to live with her. she iis filing for divorce and including that on the divorce and sedning a letter to the immigration.

help me!!

problem: she

OMG! i understand how u feel. i don't know if u believe in God and prayers but i would say what you need right now is God's intervention. Please go to google and search for Elisha Goodman, he is a man of God who owns a church in Canada called Firespring Ministries. check for prayer points that u can pray to get God involved in this case, have faith trust Him and i tell u all will be well. If u cant get prayerpoints directly from searching let me know and i will forward some to u if u have got an email i can send it to. It is well. I will pray 4 u.

Either file for divorce before she does (if she hasn't already), or fight the grounds for divorce (see a divorce lawyer to help you).

Immigration wise you can't fight the letter and there's no point in doing so. Spouses aren't often believed without proof because of bitterness that comes from breakups... which is a shame when they really are being scammed.

File for ROC with a divorce waiver and submit the evidence that you have.

It's really that simple.

Divorce your wife.

As soon as the divorce is final file for Removal of Conditions with a waiver (which is only marking one field on the I-751 form), and move on with your life.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

President Teddy Roosevelt on Columbus Day 1915
