OK-

I have been living in Brazil with my wife for 3 years now. On the journey to return home. Just received the Affidavit of Support Forms. My Dad lives with my Stepmom and he's agreed to be the Joint Sponsor for my wife. As I understand it we need to complete 3 separate forms:

1. Me (The Original Sponsor): I-864

2. My Father (The Joint Sponsor): I-864 as well

3. My Stepmom (The Household Member of the Joint Sponsor): I-864A

My Stepmom doesn't need to produce income to meet the income requirements on top of what my dad can demonstrate, so she just needs to complete the I-864A because they file a joint tax return, right?? I´m still not sure ####### the I-864A is for! The INS sites do not explain these things in a very clear way

hi,

no, your stepmom has to do nothing, if she completes the i864A it's because she is combing her income with your dad's as his co sponsor

your dad needs to put only his income and send in the W2s that will prove his part of the income on the taxes as your joint sponsor.

if she sends the i864A, she will be required to send in all the documentation as his co sponsor, not just the form.

I-864A from you stepmom is ONLY needed if your dad wants to combine her income to sponsor. Just because she's household doesnot mean she has to file I-864A and filing joint tax return doesn't matter. If your dad is making enough money and is not combining his income with her.

Look at I-864:

Q.24 part B

If your dad has not completed that portion of I-864 then your stepmom does not need to file I-864A but if he had answered them then she will need to complete I-864A

I was an international student on F-1 visa

January 2010 - Met him at a dinner party in our hometown and started dating wub.png in August
7/10/13 - Got married heart.gif to my best friend in the world (real wedding 5/18/2014 in China)
10/6/13 - package mailed to Chicago Lockbox via Fedex - DAY 0
10/8/13 - package delivered - DAY 2
10/11/13 - Check cashed - DAY 5
10/18/13 - Received NOA1s - DAY 12
10/21/13 - Received biometrics appt letter (scheduled for 11/07) - DAY 15
10/22/13 - Walk-in biometrics successful (Columbus OH office) - DAY 16
11/14/13 - Form i-485 status changed to "Test and interview" - DAY 39
11/22/13 - Expedited AP and EAD approved!! (EAD status changed to "card production") - DAY 47
11/30/13 - Received combo card and two copies of paper AP (weird) - DAY 55
12/5/13 - Interview date updated on USCIS website (Jan 31, 2014) - DAY 60
1/31/14-Rejected Green card because I forgot to mention a previous J1 visa that will require a waiver to apply for an immigrant visa...

WENT BACK TO CHINA TO WORK AND LIVE FOR TWO YEARS, HUBBY STAYED IN THE US FOR WORK.... :crying:
9/30/15-Started IR-1 application
3/20/16-Sent all required materials to NVC
4/18/16-Case Complete
8/10/16-Interview scheduled in Guangzhou, China for 9/6/16
8/18/16-Sealed medical package received (and an X-ray CD)
9/6/16-Visa approved! :goofy: :goofy: :goofy:

10/7/16-POE in San Francisco

12/02/16-Greencard in hand

If your step mom has an income, and files jointly with your father, she should sign a completed I-864A because it is easier to submit the joint sponsorship that way. On their tax transcripts her income will not be separate from his income and so their "household" income will be shown. This way you are not tracking down an individual tax return for your father which shows his individual income. Also it shows she knows what her husband is doing and agrees. However if she doesn't work, she doesn't have to provide an I-864A.

I just filed my papers this afternoon .....crying.gif So you're saying this op's stepmom should also file I-864A? I have a similar situation, my husband is still a graduate student so his income doesn't meet the 125% poverty line, so we're having his stepdad as the only joint sponsor since his income well exceeds the requirement. Attached we have his parents' tax returns for the last 3 years and his stepdad's pay stubs for the last 6 months. His mom and stepdad did file tax together for the past 3 yrs, but after researching online, I thought all we needed was my husband's 864 and his stepdad's 864, and thought that it would make everyone's life easier by not having to prove residency or relationship...

That's why I didn't file with his mom's 864A, because I thought his stepdad doesn't need her income to qualify so why bothercrying.gif So now will my case get rejected for this?

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
