Monday's three year anniversary of the massacre at Ft. Hood has left victims of the shooting spree frustrated that justice will never be done, as no date has been set for the court martial of the man charged in the worst mass shooting ever on a U.S. Army post.

"It's very frustrating, it has not allowed us to have any closure whatsoever," Kimberly Munley, who was one of the civilian police officers who helped end the shooting spree, told 1200 WOAI news.

Early in the afternoon of November 5, 2009, Army Maj Nidal Hasan allegedly jumped onto a table in a processing center at Ft. Hood and opened fire with a military issue automatic pistol equipped with two laser sighting devices. 13 people were killed and 32 were wounded before police, including Munley, shot Hasan four times, leaving him paralyzed from the chest down and ending the gunfire.

Even though Hasan was immediately charged with 13 specifications of first degree murder, charges for which he faces the possibility of the death penalty if convicted, Hasan has still not gone to trial, as three separate scheduled trial dates have passed.

"In my twenty years as a JAG officer in the military, I have never seen a case which has dragged on this long," said retired Army Lt. Colonel Jeffrey Addicott, a former legal adviser to the U.S. Army Special Forces. He is currently a professor of terrorism law at St. Mary's University in San Antonio. "Í can't think if any other case in the history of the United States Army that has taken this long."

Addicott says the Uniform Code of Military Justice, which is the military's legal system, includes due process, but generally allows trials to move more swiftly than in civilian courts, due to restrictions on the gathering and admission of evidence.

But not in the case of Hasan. First he fired his civilian attorney, then petitioned for a delay so his new lawyer could have more time to question witnesses, and, for the last several months, the case has been place on hold as appellate courts consider whether Hasan, 42, who calls himself a devout Muslim, should be allowed to have a full beard in the courtroom, in violation of Army grooming regulations.

Addicott suspects that Hasan has another motive over than religion for wanting to drag out the case. Until he has been convicted and until a military judge sentences him to 'forfeiture of pay and benefits,' Hasan continues to receive his Major's salary as he sits in a specially constructed cell in a county jail about 15 miles from Ft. Hood. For a major with more than twenty years service that comes to nearly $80,000 a year.

And I remember the Commander talking right after this. He said words to the effect of hoping this does not affect Diversity and we should not rush to judge Muslims. I was like what ? You just had a shooter inside your wire slaughter a bunch of your troops and your worried about diversity. Is the world mad .

He did that to ensure that people don't go and start beating up Muslims. Every time something happens, religion is never brought into question unless you are Muslim.

Well, we don't know what the other people's faith is since Islam is the only one they check for...
