Hi everyone! I've perused the forum, trying to find the answers to my questions, but was unsuccessful.

To set the scene, my husband and I have been together for about 8 years and married for 2 months. We have resided together in Germany for the last year and were long distance before that. I left my job a year ago to move here and haven't worked since. My husband works for an American company and has been there for the last 2 years. Although the company is American, they don't have any transfer efforts in place to help employees move between countries. He has already started talking to his bosses and people in the US about being able to stay with the company in the US, but there's no guarantee. He may have to quit his job here and then reapply with the company in the US. Our plan is to move to the US in 2012, but we wanted to get all of this fun started so we weren't waiting if we decided to leave earlier.

All that said, with the I-864 form, I am under the assumption that I am the original sponsor because I filed the I-130 petition, even though I will be unemployed when we file. My mom has agreed to be a co-sponsor, so I know she needs to fill out the form. Are we the only two that need to fill out a form? Is there someone who has been in this similar situation who could answer some more specific questions for me about filling out the actual form?

Any help would be appreciated. :)

yes you would only be the two, unless your mother needs to combine her income with her USC or LPR husband, then her husband would need to file the i864 as her mom's co sponsor

Oh thanks! You guys are so helpful. I didn't even know the I-864A form existed. It's much more straightforward and I don't think my mom will have any trouble with it. We are planning on living with her initially when we move back.

If it's not too much trouble, I'd like to go ahead and list my other questions about the I-864 and the process in general.

1) Should I be concerned that it's been roughly 40 days since we filed our I-130 and we never received a letter or e-mail with our NOA?

I-864:

2) In Part 1, since we are having my mom as a joint sponsor, do I check the box that says "I am the petitioner. I filed or am filing for the immigration of my relative." or do I check "I am the __ first __ second of two joint sponsors." I AM the petitioner, but I'm also the first of 2 joint sponsors since my mother will be sponsoring as well.

3) In Part 4, there is a place for your mailing address and your place of residence. My parents' US address is my US mailing address, but I live in Germany. Do I put the US address for my mailing address and my German one for the place of residence, or put my German address for both?

I'm registered as living in Germany, but my permanent address is in the US still. What is my Country of Domicile? What documents can I submit to meet the domicile requirement?

4) In Part 5, I am sponsoring 1 person and I put 1 for myself. I am currently married (obviously), which would suggest that I put a "1" for my spouse, but our current household is only the 2 of us and I'm not supposed to count anyone twice. This means I put a 0 for my "spouse" and a 1 for the # of people I'm sponsoring. They aren't asking about the household we will have in the US, right?

5) In Part 6, should I bother putting my husband's income? He makes enough to sufficiently cover the requirements, but we won't have any documented proof that he will have his current job once we move. I am pretty sure that I don't because we can't provide the proof.

6) In Part 7, should I list my husband's savings and checking accounts in #28? He isn't filling out the I-864, but he's the breadwinner right now, so would it be helpful to list the amount in his bank accounts?

7) Does my husband need to fill out a separate I-864 as the beneficiary, or is it just the sponsors that need to fill it out?

That should be all of my questions for now. lol. I would love any and all answers anyone can provide to clear these up for me.

I'm not able to answer all your questions, but I'll answer what I can!

2) check that you are the petitioner. You are not one of two joint sponsors- you are the primary sponsor. Your family member will fill out their own I-864, where they will indicate that they are the joint sponsor.

3) I would put your residence and mailing address as to where you are actually residing and where correspondences from the USCIS should be sent. Your mother would use her US address.

- your country of domicile is where you see yourself permanently residing in the future. As the petitioner, you should choose the USA for this section of the I-864. In the notes (step by step instructions), they list several things you can use to prove US domicile. US Bank statements, house/apt lease, letter from employer are a few.

4) This one confused me, too. Read the notes that I referred to above, they provide a little clarity. I am putting '0' for my spouse, since I already put '1' for the person I am sponsoring (who IS my spouse). If I were to put '1' in both sections, I'd be counting my spouse twice.

5) if your mom's income is enough to sponsor entirely, I wouldn't include your spouse's income.

6) if you need the money in the accounts to establish the financial requirement, yes. If not, I wouldn't bother. It's just extra.

7) only the sponsor (you) and joint sponsor (your mom).
