My fiance(a US citizen) filed a K1 visa in 2008 for a filipina fiance; got married and got her 10 yr greencard. divorced was finalized in 2011. We got engaged this year and filed for K1 visa. My questions are:

1. will his previous K1 application hurt our recent K1? (it's 6 months since NOA1 and we hear nothing from VSC)

2. is there some specific things we need to do since he is still currently sponsoring her 10 year greencard?

Please give me a heads up, i'm such a babe in the woods in these things.

* August 17th 2012 --> IV Package Sent

* August 24th 2012 --> NVC Case Complete

* September 15th 2012 --> Interview Date Assigned

Yes, it is a red flag. The only thing to do is to provide solid proof of a bona fide relationship. A red flag isn't an automatic denial, it is just something out of the norm.

No it is not a red flag....as long as he has the certified divorce decree....and he sent in his letter asking for the waiver.

Now, should the new fiance expect to be questioned about it during their interview? Yes for sure.

Make sure you know all about that previous relationship.

Also expect some "extra" scrutiny since the date of his divorce and the date of your filing is somewhat close together. The Embassy wants to protect you from the possibility that he is moving too quickly from one relationship to another and doesn't want you to "end up" like the former immigrant did.

It's likely to be more of red flag at the consular interview than the petition stage - particularly with the affidavit of support. I would defer to those members from the PI to relate their experiences and give advice, though.
