Is Having No Job at Time of Interview a Problem???PLEASEE HELPP

Heyy everyone,

Soo I still have some time before any appointment being made for the interview (hoping everything goes well), its been two months today that my petition was sent to USCIS, but i had a question for my fiance. Things aren't going well at his job and he doesn't know if he will still be at this job when the interview comes around. He thinks he will last about two more months and the interview wouldn't be until after that (just going by estimates). Now would this have any affect on him if he went and didn't have a job. Will they look at him any different if he was collecting unemployment?

He was worried about not having a job around then if they will say anything to him or look at it as weird or have any negative affect on him. If anyone has any insight on this question please let me know what you think or if anyone had any experience with this situation.

Based off the research I have done, the petitions income matters...not the beneficiarie's. After all, they will be leaving their place of employment to move to the US and your goal is to prove that you can support him/he in the meantime until they find work here.

We'll see what other ppl insite is :)

If you are referring to the petitioner not having a job and receiving unemployment. More than likely they will be asked to have a co-sponsor as unemployment does not last long. Unless they have enough assets to meet the poverty guidelines. If it the beneficiary that will be without a job then I agree with the others, it will not matter.

Thanks soo much for the quick replies, it definitely helps with nerves when thinking about anything with this process lol....my fiance is the beneficiary (he will be the one without a job)

I'm currently a student so i will be having a sponsor so that's not an issue, our biggest concern was thinking that they will think hes trying to stop doing things before the interview, basically preparing too soon and they may look at that as a bad thing, but its simply his job isn't working to well and he will most likely be on unemployment. When we talk about it he says that if hes going to be on unemployment he rather not look for a job since we have such high hopes with the process going well just to work for a couple months and leave.

Anyone else with insight on this situation will be greatly appreciated...

I just finished my practical teacher's Training in September (in Germany, after your university education, you have to do a 2 year practical training: you basically work as a regular teacher, but at the same time still have to take classes and tests and you get paid a LOT less than regular teachers ;) ). I didnt try to get a new job after that, since we had received our noa2 on August 30th and i didnt want to start working at a New job, knowing i would only stay for another month or so. I had my interview on October 24th and when the consul asked me what i was doing for a living, i told him that exact same story and he was fine with it. Just asked me what i am going to do in the us! Although, i have to add, i am not collecting any unemployment money.... (but i doubt the consul would know that). Dont worry, you guys should be fine!

there is no need for the beneficiary to have a job. He will be coming here and relying on your income and will not be able to work for quite some time once he is here anyway, and the consulate know this.

It's the petitioner un/employment status what matters in this k1 process. Besides if the beneficiary has a job at the moment of interview is not important as he/she will quit job in order to move to USA.

I agree, it is the petitioners income that is taken into account during the K1 Visa process. I was the beneficiary and I had left my UK job (to allow me to spend more time in the USA with my fiance) about 6 months before my interview at the US Embassy in London and my visa was approved that day.
