Dear All,

Our I-130 petition got approved on the 1st now we will soon be requested to submit AOS form, now we have a joint sponsor who is my uncle and he is a doctor in USA for the last 20 years and he has agreed to sign I864 A form, no the question my wife has never worked in U.S will she still have fill AOS form and we can attach my uncle's sponsor in the package.

Please help!!!!!

Hello! Yes, your wife will fill out form I-864, even though she has no income. Then, her Uncle will also fill out form I-864 as a Joint Sponsor (not I-864a...that form is for family members living in the same house such as parents, spouse, and siblings). Hope this helps!

Thanks for the reply but he is my maternal uncle and he doesnot live in the same house

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, he can be the sponsor. And yes, your wife's income does not matter, as long as you have a sponsor that meets the income requirements. She will fill out form I-864 and so will he :)

My wife doesn't work in the US right now because we are living abroad. She sent a I-864 with ZERO income and a letter explaining why she was unemployed. Along with that we sent a I-864 from our joint sponsor and all supporting documents.

If your wife didn't file taxes for the last three years she will have to send a letter explaining why she was not required to file taxes along with the "unemployment" letter.

My wife doesn't work in the US right now because we are living abroad. She sent a I-864 with ZERO income and a letter explaining why she was unemployed. Along with that we sent a I-864 from our joint sponsor and all supporting documents.

Can you please advice me on what is the format as she will write a letter explaining why didnt she had to file tax returns and is this letter and unemployment the same and who should the letter be addressed to.

The letter should be short, and have her original signature. Here is what my husband wrote:

To Whom It May Concern:

I am Mr Penguin, Penguin's husband and petitioning sponsor. I did not file an income tax return for the years 2005, 2006 or 2007 because I have not worked during my 3 year residence within the Republic of Ireland. Once I came to Ireland, I was unable to find work and so used savings; I was maintained by my wife upon her income and savings. Since I made no income for these years of any type, I was not required to file an income tax return with the Internal Revenue Service.

yes both ur uncle and wife will fill out I-864 form. Make suree your wife writes a small letter explaning she does not work and is not required to file taxes. If possible she can attach a irs transcript that shows she's not required to file taxes but this is just optional.

You uncle will also complete I-864

Also send his W-2/1099, employement letter and recent tax return and copy of paystubs from past six months if possible

Also send his citizenship proof such as photocopy of his passport
