hi l filed a vawa petition in sept 2012.l received an rfe on the 16 October 2012.l responded to it and four days later l rcved a prima facie.l did not hve a restraining order against him.could my case be denied because of this?how long will it take to hear from them?lm living in a dv shelter with our two babies.(my husband and l children.).can l appy for ead at this ooint?coz lm really stressed hve no money living in a shelter don't know how to take care of my babies.what benefits can l get in massachussets with a prima facie.thx all

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

They will approve your vawa considering several things, and it's not mandatory to have a restraining order against him, but it will help if you have a police report letter from the shelter, hospital record.

You can apply for public benefits with the prima facie, your kids and you will be able to get food stamp and medicaid,but MA they don't use to give cash assistance with prima facie.Join us in the thread Vawa 3...

YOu just can get EAD if you file form I-485 ,they can't issue EAD without a pending form I-485 or form I-360 approved, but keep in mind if Vawa unit deny your form I-360 they won't initiate removal proceedings, but if you submit form I-485 and they deny your vawa they will initiate removal proceedings, then you need to thing what you want and go for it.If you need to work then you must file I-485 now if you are not in removal proceedings of course.

I have pending vawa case. This is my problem at the time it was filed my husband was only a LPR now he has receive his citizenship . Can any tell me what can I do now . For the record I did not send in a adjustment of status or EAD application.i really need to work I need help.
