Filing a lawsuit does not indicate anything about our country. I can file a lawsuit against YOU for me not getting a drivers license in Vermont. So what?

What WILL determine we have lost our mind will be if the court decides to hear the case and if the court rules in his favor. I give little chance to the former and -0- chance to the latter. What it DOES indicate is that there is an abundance of blood sucking attorneys that will take money for anything.

This could (but will not be) changed with a simple change in the law.

It will not be done because it would eliminate a lot of business for attorneys and lawmakers are nearly all attorneys.

Agree but my point was, that we have such a messed up immigration policy that a Illegal alien can openly bring a law suit in court without fear of someone going, "hey you're here illegally the law states I should deport you". If he was appealing his immigration status, then fine give him a stay until it is done, but his is not the case.

The problem with illegal aliens is you and everyone else continually refer to it as an IMMIGRATION problem. Illegal aliens are NOT an immigration problem. THEY ARE ILLEGAL! They are NOT immigrants. There is no problem with the "immigration policy". Under immigration policy they are ILLEGAL.

The PROBLEM is that we do not enfore our labor laws against U.S. EMPLOYERS who exploit illegals for profit. When are we going to impose untenable taxes on employers for avoiding our labor laws by exploiting humans?

"Americans (legal workers) won't do those jobs" BULLSH*T, so why aren't LEGAL Mexican immigrants doing those jobs? Are you kidding me? Only ILLEGAL Mexican (Hispanic) people can/will do those jobs? They are hired because they are CHEAP. They are CHEAP because the employers do not PAY all the taxes and benefits and other expenses such as workman's comp insurance that they need to with LEGAL workers. Make an illegal Mexican legal and he becomes unemployed and replaced with another illegal Mexican. He was not hired for his work ethic or because he is the best roofer in the world or for his language skills. He was hired because he was cheap, because he is being exploited for profit. Make him legal, and he is no longer cheap. Buh bye!

We went to WAR with Spain in 1898 for their similar exploitation of Hispanics, now it is perfectly OK to abuse humans and smuggle them in cattle trucks for PROFIT right here in the USA.

NOW, you go to his employer and close his business, padlock the door and hand him a tax bill for $3.6 million and tell him the lock comes off when he pays the tax for violating labor laws, Federal tax withholding laws and for not having workman's comp, and the guy who filed the lawsuit will WALK back to Mexico and abandon his lawsuit tomorrow because NO ONE will dare to exploit him.

All this nonsense is to keep everyone's eyes off the ball. Bicker about fences, citizenship policy regarding babies born here, etc., etc. and ignore the REAL problem that NONE of the politicians want to address.

Then go have your presidential election between two guys who will do NOTHING about the exploitation of humans for profit in this country...and tell me which one is "best" What an effin' joke.

We have been through this before and agree. I stand by my statement we have an immigration problem. When someone comes to this country Illegally it is still immigration isn't it ?

Well, some here seem to question the individual's right to due process. If she's truly blind, then the individual's legal status should not impact the individual's right to due process.

The ONLY thing needed is to place a TAX on the employment of illegal aliens. Taxes are great because they avoid the due process of criminal charges. Padlock the door until the tax is paid. If they want to dispute it...go right ahead. The padlock stays until it is settled. Do that to 2-3 businesses and the problem is solved. Anything else is smoke and mirrors. People are not avoiding the law they are using the poorly written law and the loop holes in it to their advantage. Most states do not require E-verify and the ones that do can not use it to check already employed. Even many of the states that require it do not make it mandatory for businesses below certain numbers.

I am glad I was not eating cereal when I read the attorneys argument or I would have had a mess to clean up on my monitor. Beyond crazy argument.

.. Anyway this should be a simple infraction, not even a misdemeanor. Why is it even being given the opportunity to be considered by a higher court? The state should just drop the charges and send him home for being here illegally with a lifetime (or 10 year) ban... Money saved, problem gone, no possibility of some stupid precedent being set.

If I hire someone to mow my lawn I should be able to verify they are legal to work with a phone call or a website. E-verify should be mandatory nationwide.

we already have that system. Ok changing how immigration status must be handled, reported and the requirements to work in this country has nothing to do with immigration law and code. . Yeah ok..if you say so.. You win peace.
