OK, but what i will need to file again?

and how i'll be able to find out the specific reasons for denial? how can i contact them to address the reasons for denial?

Your fiance should contact them for reasons for denial. Your fiance should have contacted them to inform them of the hold up with the I-134. We would have told your fiance that if she were involved in this forum. Many people have recommended that to you before,no?

I mean you are in for await like 4 to 6 months. Some petitions sit at embassy. You need to realy call them. It's a dang shame to let this slip by just because you had the wrong forms.

Since you didn't bother to keep in contact they probably figured you no longer were interested. So call or email them letting them know. In fact I would get that form you posted and march down to the embassy and tell them "I am waiting on the paperwork from my finacee". Tell them about the delay and the loss documents (Oh I so can relate to that).

Get in it before your petition goes back. Don't waste time. Than as I said waiting game . Like there's nothing you can do until it gets back and you are denied or reaffirm.

I think i have to email them cause i tried to call them but it's not a good idea.

Yep, they have and i should have contacted the consulate to let them know that i'm waiting for the I-134 and other than gap age and this paper, i really don't know the reasons why they would deny it.

It would be a lot of help if u can clarify how the interview went, and if they see any red flags, if it was due to the fact that u use the wrong form than it wouldnt be a denial but a 221g and they will just be waiting for documents from you. But to say that they will send ur case back to USCIS its a denial. Best thing to do is have your fiance the petioner gave them a call or sorry email than and ask what is it they want and why its a denial. If your fiance need to apply again later down the road than she would need to see first why you guys got denie in the first place so the second time wouldnt be so diffcult.

You interviewed a while back-- why didn't your fiancee send the form already? Sorry to hear about the denial.

she sent me the wrong form "I-864" even all that consulate keep it when i gave it to them and then they gave me 221 g writing in it that i have to bring them the form I-134. So after 5 weeks of my interview today they sent me to my Gmail the paper i uploaded here, and before that someone from consulate called me and asked me about my adress email to send that paper to me then i gave it and got this bad news, he called me after 4 pm.

between in 221 g it's written i have one year to provide it. i don't know why they took decision already.

Z after it goes back it is not always followed through and they have rarely contacted the beneficiary (as of late) as stated... beneficiary "maybe" will receive a notice in the mail that since nothing was done with this case we are closing it.

Your fiance needs to get proactive and do her best to contact the consulate to find out what was your "mix up" with papers needed as appose to you not being approved, but I am not sure 5 weeks after the interview is the right time....Or when your petion goes back, she can try to keep calling USCIS to make an attempt at your visa still being alive.

Zagray, you can do a bit of deductive reasoning on the letter the Consulate sent you. There are only a handful of reasons you can be denied a fiance visa:

*you have a communicable disease

*you run the risk of becoming a burden on the US government

*you've been found guilty of a heinous crime (murder, rape, human trafficking, arms trafficking, drug trafficking, racketeering, etc.)

*you are associated with a known terrorist organization or you appear to intend harm to the citizens or government of the US

*your relationship is not (or appears not to be) legitimate

Since the document you received doesn't have check marks next to the ones about communicable disease or becoming a burden on the US government, I'd have to assume that they either found something in your background that makes them think you wouldn't be a law-abiding resident or that your relationship is fake. Only you know your history. I can't answer for you what the problem is because it's something only you know. If you don't have a criminal record of any kind and you don't appear to have potential for terrorist acts, then I'd say the problem lies in the appearance (or lack thereof) of a legitimate fiance(e) relationship. If that's the case, then you will need to find more convincing evidence of your relationship's sincerity before applying again. Otherwise, the others are right: you'll just be denied all over again.

On another note, it does seem somewhat suspicious that your fiancee doesn't appear interested in taking this process seriously enough to do her own research.... perhaps that, in itself, is a red flag? Hope this helps...
