Hi... I am not sure if im posting in the right forum but just please move it if necessary... So here's the situation and question...

My stepdad petitioned his brother and his brother's daughter to come here and signed an affidavit of support for them of course and visa was approved and got here 2 years ago. His niece decided that she is not happy and left to move to another state but before she moved to another state she went to visit her bf in canada and stayed there for 6 mons. While there she got pregnant and they got married before she left to go back to US. She went back to the US to wait for her husband's petition to be a permanent resident in canada. She doesnt have a job and is pregnant so she applied for medicaid and recently got approved. Her relationship with her husband is in limbo now coz she havent spoken to him for a month now and she is due to give birth in 2 mons.

Question:

1. Will my stepdad get in trouble coz she applied and got approved for medicaid without his knowledge coz he signed an affidavit of support for them?

He won't be in trouble, but he may need to pay it back to the state. It depends on if the medicaid is a means tested benefit/ what sort of benefit she got- some states have programs especially for pregnant moms that an :PR may be "allowed" without paying back.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The only way it will affect your step-dad is that he MIGHT get a bill for it. It's not guaranteed he will, but as the sponsor that's the only way her actions affect him, financially.

Oh ok thank you... Do u know the chances of that from happening?

Unfortunately there's no way to know for sure. He will only know if and when he gets a bill. Some people report they never got a bill (even though they know for sure that the immigrant used something they "shouldn't" and the sponsor had to pay it back), other people report getting a bill out of the blue.

Has anyone told her she shouldn't be using these benefits? I know she qualified but most rational people if told someone else, they KNEW, would have to pay for their choice they would stop. But some people also couldn't care less that other people would be stuck with a possible bill in the hundreds of thousands.

That's why anyone signing the affidavit of support should be fully aware/agree on what they are getting themselves into when signing the document.

Most people will promise they or their family member won't use mean tested benefits, but life is full of surprises. People will do what is in their best interest, and the promise becomes worthless.
