Hello all,

I don't know which forum to post this question so I am just going to post it here and hopefully they will move my post to the appropriate section. Anyhow, I am wondering if anyone has experience on the prenup and how much they are paying to the lawyer?

I know I have to find my own lawyer and my fiancee has to find hers. However, she is in Brazil so I guess I have to find one for her too. Does anyone have experience on this? Please share your experience. Thank you. By the way, she agrees to do this as well.

You need to do the pre-nup once she arrives in America. She can not do it there. Yes, you both need your own lawyers and if he English is even a tiny bit weak she will need an interpreter or lawyer that speaks her language. I would say the pre-nup could run anywhere from $ 500-2000. Even more depending on the situation but there are no guidelines.

There is a pretty good book in pre-nups called write your own pre-nup which I would not recommend doing but the book will have you knowing more about what is important and what you should ask from your lawyer than he may even knnow. You can get it on Amazon and it is very worth the invesment.

How much money do you have? If you have no money, why exactly dod you need the prenup? Is there something you need to protect from her? The rule of thumb is that prenups are not for poor people.

This is not at all true. Wealth is not necessarily the issue...it could relate to future inheritance, retirment annuities, 401Ks all of which are not in hand at the time. It can also detail how marital matters are to be handled, and most especially if there are children from prior marriages involved. There was a thread going last week on VJ that addressed this very issue!

As to the actual endorsement and memorialisation, agreed, it may need to be done here, but the parties can at least review what is "at issue" beforehand.

Thank you. I will do the search on prenup from last week.

It is true that prenup is not necessarily protect my wealth from her but prenup can include so much more so that everyone is protected. I think it as more like a life insurance policy for me and for her.

Does it matter how much money he has? It's personal, as his reasons to request a prenup.

I had a prenup written up as I think anyone one should if they have anything of value. A friend's Dad wrote it up so the cost was minimal ($200). Inside it said that my fiance had refused council and that it had to be translated into his native language. (Which cost us about 55 euro in Albania). Two separate attorneys are not required and depending on your fiancee's assets may be impractical. There is no reason it can't be written up before she is here. Hope this helps.

The last thing we need is another mind numbing thread about a guy who drops a pre-nup bomb on his fiancee just a few days before the marriage and then dump her and her daughter on the street because she refused.. It is good that you are handling this in advance with your fiancee!

YMMV

Laws vary by state. Some states require each party to have independent counsel and that the contract by finished a certain amount of time before the wedding.
