November I-130 Filers

People are being called for interviews because traditionally local field offices were only involved if the USCIS needed an interview with the petitioner.

yes, i understand that local field offices are involved in the interview process. if you look further into my posts, i am asking for the reasons why.

i want to see the different reasons that petitioners are going in for interviews.

for example, faith26 and her husband have been married for five years. my wife and i have been married for almost three, both faith26 and my wife are from the philippines. why did he have to go in for an interview and not me?

how much evidence did the petitioner provide to show that they are married besides the documentation USCIS is requesting? did they provide pictures, letters, emails or phone bills? if so, is the petitioner still being called in for an interview?

It is ENTIRELY dependent on the field office, and the person looking after your case. There is no rhyme or reason. You're trying to find a reason behind something for which there is no reason, it's a person's individual decision. That person thought... Oh this really old manual, the only one I have to work with says that these forms are only sent here if I have to interview the petitioner so I better do that. Other people are smarter and figure out, hey, I can just check the boxes and send this along, no sense wasting my time. It won't make sense, don't try to make it make sense. You'll just end up with a headache. biggrin.gif

There is no sense to be made out of the field offices. If they are going to keep up this transfer thing, they need to get them all on the same page or in the case of Atlanta get them working.... :whistle:

My two I 130's been pending now for 100 days, field office is Phoenix , last update is 12/18/2012 can someone tell me what to do, the wait is killing me, no NOA2 yet!!!!

original reason was typically because beneficiary had overstayed or been involved in immigration preceedings

but no particular reason now

Or in our case, to totally screw us over for complaining. First send us a letter stating that you can't process our case because we are in Denmark, then decide that the petitioner needs an interview because their address is in America with USCIS. Which will it be Hartford? :bonk:

Wait on the field office is all. I'm not sure what their current guidelines are, but you may be able to file a service request at 5 months to look into it. Remember, though, that under 50% of filers from Nov 6/7/8 have been approved. That is still quite a lot just sitting around.

Does that mean they were never transferred anywhere? I am bracing myself for a long wait it seems. It sucks to been right now. I have not seen my wife and son for almost a year!

How do I make an expedite request?

Why would you need an expedite?

Do you qualify or would you just be wasting time?

My family is in a volatile environment where the country is in the electioneering period. Cases of threats and violence have been reported. Their elections in the year 2007 were a bloodbath in some parts of the country. Am thinking that my family would be safer here, don't you?

Sometimes that works, sometimes it doesn't. You might want to start a thread with specifics and get some feedback.

The field office adds a curve ball to it as they don't seem used to handling expedite requests.

Totally agree they'd be safer with you. But I don't know if that's ground for an expedite. They might be able to claim refugee status though? I'm not sure. You definitely want to check out your regional forum and it might be a good idea to contact your senator or congressman. I hope everything turns out well for you.

After filing a service request, 01/30, I received a letter yesterday. I was requesting information regarding where my case was being processed, so I could at least have a clue where to look for processing times. I originally mailed my paperwork to Chicago. Then, my NOA1 stated that my case was at NBC in Missouri. The website shows that my last touch was 12/17.

I was glad that I received this little bread crumb of information as I was feeling like my case might be at the bottom of a black hole! The letter states..."The I130 was transferred to Memphis, TN USCIS office on December 21, 2012. Our records indicate that you are awaiting an interview date. We will schedule this appointment and a notice will be forthcoming."

I am in Nashville, so this makes sense that it would be in Memphis, but Memphis does not show on the USCIS site as processing I130's, so I have no idea of their processing times.

For those of you who were transferred to a local field office, how long did you wait until the petitioner was interviewed?
