November I-130 Filers

Guys, I had a question ?

What if I ask my wife to apply for a visitors visa to the USA, pay the fees, and send her the sponsorship papers etc. and go down that path.

We shall explain to the immi officer that due to the delays in the I-130 process, we would like to seek an approval for the visitors visa while waiting on the approval of I-130 it would give my wife an opportunity to come visit me.

Now the question is: a) what are the chances that she will get her visitors visa and b) what if the immi officer rejects the visa in this case will it impact our I-130 application. ?

Has any body in the VJ arena every tried this approach ? Please advise.

I'm sorry Hope but it is very unlikely that your wife will be approved for a B-2 while an I-130 petition is pending. In order to be granted a B-2, she must show strong ties to India which is difficult and complicated by the fact that she has a USC spouse. In the Immigration Officer's eyes, she has strong reasons to remain in the U.S. and adjust status instead of returning to India. I am sympathetic to your situation. I would also love for my husband to visit me in the U.S. but I don't want him to waste money only to get rejected. It's a tough situation. :( Travelling back and forth to India is a long tiring journey especially when you're making the trip alone.

In regards to your second question, a B-2 rejection will not impact your I-130.

Good morning..

Our I-130 is in NBC for 2 and half month, no news, nothing. My husband tried to call USCIS but haven't succeed yet. Can he take infopass at his local USCIS office and ask the officer for how it goes? Can he do that? or that officer can help him atleast to check where the file is and how long we can expect to get approval?

Thank you for your well thought out detailed response. Indeed there is conflict of interest between immigrant(I-130) and non-immigrant visa(B2) which answers my 1st question.

He certainly can make an InfoPass appointment but I just went to one and it was useless. My local office told me that they are not processing standalone I-130 petitions in the office (untrue). Since they denied the fact that they process I-130 petitions, it was useless for me to ask if my petition was currently there.

He should try anyways. Maybe his office will be more helpful.

Thank you so much. I did ask him to be a bit more patient and call them again. If not, hopefully his local USCIS office can help atleast to check where the file and when did they send. Phewwww !!!

Totally agree with the travelling back and forth alone! :unsure:

I'm a November filer and got approved yesterday at San Antonio field office during my hubby's (USC) interview. Thank God. Now, on the NV stage. God bless everyone who are waiting to be approved too.

Are you living with your spouse or not, man i want to get approved already and it is taking forever, and it is getting harder and harder everyday! oh God please help!.
