November I-130 Filers

Wouldn't you have to be living there for 6 months to qualify for DCF? That would be worse than thinking of reapplying from DK again. It would be more like waiting around doing NOTHING for a month and then reapplying using your American address.

Are you going to wait to see what happens with your expedite request before making a final decision on what you want to do next?

I'm going to wait it out, but I think that they haven't responded to the expedite is a pretty good indication that they won't.

If it ends up being transferred to Hartford we could be in for a wait until the end of the summer or something. Look at the situation with Atlanta.... I think though having two I-130s in the system might do something hinky.

The problem is that I don't want to wait another day in Denmark. I hate it so much and our family is really suffering. Maintaining the two separate households is going to be a huge burden for us and I don't think we can afford to do it. I just don't know what to do at this point. We wouldn't have filed the I-130 to go back if it wasn't already a pressing situation....

I defo understand that you have a serious issue and that maintaining two households really isn't an option. I'd be nervous as well about having two I-130s in the system. It'd be one thing to have a K-1 visa in the system and then applying for a CR-1, but not two spouse visas.

You've been at NBC for nearly 3 months now, though. If they were going to transfer you to a local office, wouldn't they have by now? I'm not sure of that kind of timeline, since we never left the NBC.

I know that you are dealing with some terribly stressful scenarios. You'd planned on going back to the States as it was in May, yes? It might be completely out of the question, but could you and your daughter afford to spend some time with your other family in Europe just for some respite from your situation in Denmark? I'm just trying to think of something that could give you enough of a lift to get through this next little bit.

They still haven't transferred us even with the American addresses. Color me confused.

Well not all cases are being transferred, some are being approved out of NBC w/out being transferred at all. Yours might be one of the them. What I meant is that I haven't seen ANY file abroad cases be transferred to a local office, by file abroad that means the address of the petitioner is overseas.

Correct. We did not state she was in the US currently and we filled out her address abroad on page 2. If they set us up for an AOS they will be making a stretch of an assumption... although it seems that using her american address on page 1 may have slowed us down. I had thought all i130s (regardless of oversea or america) were being to transferred to local offices due to workload, but it sounds like you are saying that is not the case for overseas filers...

I know, but you did put an American address on the first page under her information, right? Some idiot might take that to mean that she's in the states, we've seen weirder things happen. I wouldn't put it past them!

Hey Everyone!

I just got my service request letter from USCIS pertaining to my wife's I-130 petition that I requested on 03 Jan 2013.

Systems show that my petition has not been adjudicated and is still pending at your local USCIS Field Office.

So it's been here in Las Vegas for I don't know how many months.

When I checked the processing volumes and trends for Las Vegas, they've only completed 164 cases in the monthe of November while there's 1925 cases that are pending.

The trend for I-130's have been going up since June of last year for the Las Vegas Field Office.

I'm going to schedule an interview on INFOPASS, talk to an ISO at the Field Office and ask how much longer before my wife's file gets touched again.

If my premonition is right and they tell me it will be about 8-10 months, then I will file an I-129f (K3 nonimmigrant visa) because the processing time is only five months.

I'll keep you all posted...

My husband is having some minor surgery in 10 days that we just scheduled that requires him to take the whole week off from work because his job is a little too physical and they have to take bicycles in between job sites, so we are planning on going somewhere and are trying to figure out what won't be too far away but yet enough of a change. I'm thinking Amsterdam, but I had wanted to save my trip to the Netherlands for April when all the tulips and things were out, but it has yet to be decided.

Well, my address was overseas, but now it isn't, so who knows? I think based on the other cases, ours would have been looked at at around December 17th when the touch happened, but by then the address was already in America. USCIS would save a lot of frustration by just making the process more transparent.

I'm not sure the I-129F is going to go any faster. I mean all indications are that they just match them up. I haven't seen anyone recently who had the K3 before the CR1. It is worth a try if you think it is slow, but I did see someone around here with an RFE from Las Vegas, so they must be processing some cases. I'd be very interested in what they have to say at the Infopass, though.

People have said before that it slows down the I-130 because they pull it to match it up with the I-129F. I have no idea if that is true though.

When NBC transfer our files to field office, do they transfer to the office close to the place of petitioner or just random? Sorry if I ask the silly question?

Seems to be the office that has jurisdiction over the petitioner's address.
