Some more info in case it helps:

I put my american address (mom's house) for both of us as we receive mail there for everything on the i130. However on the portion that says 'relative's address abroad' I put our overseas address. San Francisco office (where my paperwork is at now) serves the area of my american address.

That's why you were transferred to a field office, you should have put your overseas address on both sides of the i130 People who file from abroad shouldn't get transferred to local offices. They probably think you're in the states, and they might even think your spouse is too!

They still haven't transferred us even with the American addresses. Color me confused.

Overseas or american- after NOA2 they all go to NVC correct? In which case I am not too worried. Or are you saying that American-addresses skip NVC and stay at local office for the rest of processing?

I travel frequently to USA and it genuinely is my permanent address. My wife was in US with me when she filed but she now overseas during this i130 process.

Filing abroad has been getting approvals in 30-60 days.

After that point. Doesn't matter.

What KDH said, it's more in the interest of speeding up your case, that's all. Also, after you get NOA2 approval I would double check that your case isn't pegged as an Adjustment of Status. The reason I think they might make this mistake with your case is b/c you put an american address for your wife that means that she currently lives in the USA and so would apply to adjust her status. That would seriously mess up your case, and I REALLY hope they don't do that!

The real question, would be if they answered that properly since at the time the spouse WAS in the US, but should have been selected as NO since they were not doing an AoS.

Correct. We did not state she was in the US currently and we filled out her address abroad on page 2. If they set us up for an AOS they will be making a stretch of an assumption... although it seems that using her american address on page 1 may have slowed us down. I had thought all i130s (regardless of oversea or america) were being to transferred to local offices due to workload, but it sounds like you are saying that is not the case for overseas filers...

I asked for MONTHS if canadians got expedited for filing abroad.

They all said no.

That is slow and I've been thinking of how long AOS might have taken. I don't think we'd do it because he can't work waiting for EAD and would just be sitting around the house doing nothing.

I'm also seriously considering the UK and doing DCF.

Wouldn't you have to be living there for 6 months to qualify for DCF? That would be worse than thinking of reapplying from DK again. It would be more like waiting around doing NOTHING for a month and then reapplying using your American address.

Are you going to wait to see what happens with your expedite request before making a final decision on what you want to do next?
