Visa refused or RFE

Hi guys

Yesterday I had my interview and I was so surprised when the consul stated she was not able to approve my visa unless I bring proof my fiancée is working.

The story is that my fiancée decided to quit her job and live with me for past year. Of course we got a co-sponsor who satisfy the financial requirement, but for some reason the consul want my fiancée to have a job in order to approve my visa which is not a real problem cuz my fiancé is already evaluating job offers but u guys can understand my surprise. I read a lot this forum before and it seems that most of people apply with a second co sponsor without problem.

However, the only doubt I have is that the consul gave me yesterday a refusal worksheet where is not written that I can provide evidence to have my visa, but she said I have 90 days to bring a copy of my fiancée contract and go there with that refusal worksheet after I will reserve a new appointment by phone. Is it right ??

Thanks

hmm. I am in a similar situation. I've been staying with my fiance in his country for the past year. But we're still waiting for our NOA2. I was going to use a cosponsor and I was told that was OK. I am not sure why they denied you. I wonder if it depends on the consulate.

Unfortunately, it isn't necessarily right or wrong, it is the way the immigration process is. The interviewing consulate officer has the authority and duty to determine, to their satisfaction, that the intended immigrant will not become a public charge in the US. If you want to get the visa approved, I would suggest that your comply with the consulate officer's request.

Good luck on your visa journey.

Hi I am New to this process and I am in that situation. I am starting this process by sending the package today or tomorrow. However, I am a college student and I am unemployed at the moment. How would that case be handle? would I have to start working or can I simply use a cosponsor? Also, if I have medical bill still on file would that affect in any way since they have my social security?

Welcome to the forum.

You present an interesting situation, though seen here fairly regularly. If you haven't already, take the opportunity to review the I-134 Financial Affidavit section and FAQs, located in the step-by-step K-1 visa guide. This can be easily accessed by hitting the "Guides" button at the top of the forum page. There you should be able to obtain more information about the financial requirements of the K-1 visa process,

Good luck on your visa journey.

Interesting, we have an appointment coming up with a very similar situation - I (the petitioner) just graduated from grad school, and have been in Italy for the summers with my GF. Hopefully we dont run into the same problems - we also are using a co-sponsor (separate i-134s and proofs etc..)

What did you file on his i-134? What did you put for occupation and salary, and what proof did you submit? Did he have tax forms and/or statements from the bank with deposits, and/or stocks and assets listed?

I haven't heard this problem before, as you, I have heard that a co-sponsor is pretty common practice --- even in Italy.

My only guess, other than a personal policy is that the consular found something that made it questionable the support you would be receiving?

Juarez will accept a co-sponsor, and they do not care about your debt. You just need to meet or beat the 125% income requirement for your household size or have a co-sponsor that meets or beats it for their own household size plus the foreign fiance(e). It is based on gross current annual income and debts are not even asked about. They play no part, unless someone owes back taxes.
