NVC Filers - November 2012

Last week we received two different NOA2s - the first said that our petition had been approved, but since the petition indicated Adjustment of Status as the preferred option (not true) we should either fill out form I-485 or request a change to consulate processing using form I-824. The second NOA2 was more in line with what I was expecting and said that the petition had been approved and that the file had been transferred to NVC who would be in contact shortly, but the cover letter from the local office indicated that my visa classification was CR2 rather than CR1.

Has anyone encountered this before? I'm hoping this is just a function of my local office not dealing with a whole lot of I-130s and getting confused with the process. Hopefully the file will make it the NVC ok and we can sort any errors out there.

Hi! Do you have any ideas why they asked past 3 years IRS transcription that is not mandatory? Did you get any explanations from NVC?)

The first package I sent included three years IRS transcription. The I-864 is clear on the fact that either this OR the current COMPLETE 2011 tax filing is required for AOS. For me to send the complete 2011 income tax filing would be (is) a book. This is why I chose the three years transcription option.

I own three businesses...the CPA's make a small fortune from me on my taxes! When the Checklist came later they did want a COMPLETE copy of 2011, so then of course I complied. Mailing that was not cheap on Overnight Express..but I complied.

They then "Checklisted" us on my Wife not having a Police Report from Uzbekistan where she attended University from age 16 to age 20. The latter is a legitimate demand. We can't whine much about that. It took a month and a half and some bribes in Tashkent to get it but they now have it and the Translation (Notarized) of this Police Report as of November 7. NVC does not explain anything in detail to Petitioners. They make demands and you comply. When you call them these are Contractors your speaking to. These are Kelly Girl types, not Visa specialists. They look stuff up on the Computer screen and report what they see to you. That's it. Your not talking to Aeronautical Engineers like I am when your speaking with them. Keep that in mind, they are not correct on many of the answers they give you.

(I'm just waiting NVC review about my I-864. It was delivered to NVC in same time with DS-230 but in separate mails on Nov 01, 2012.)

That's ok.. we did the same. I mailed them in separate too and they have them. Sometimes a Checklist might come if they had one in hand and not the other, even though you sent them both. The mailroom here must be a total mess is all I can determine. Anyway..a "false" checklist item might happen..don't get worried..your DS-230 will arrive ok and will be matched with the I-864 you sent IF you put your NVC case number you called for on every page on the upper right hand corner. Don't forget to add this code number to everything you send them.

(Yestarday (Nov 16) I called to NVC. Result: DS-230 - accepted | I-864, AOS - received by NVC but haven't been reviewed yet. ... and 5 hours later I have got e-mail ***CHECKLIST COVER LETTER for I-864, AOS*** »»» *...The NVC has received the requested Immigrant Visa Application (DS-230). However, we are still waiting for the Affidavit of Support form...*

I guess I should ignore it but situation with yours case is very strange for me and I'm almost ready for some NVC *surprises* too.)

You got the "false" checklist. Don't worry..you sent them to New Hampshire and they will be processed. If you do not see any more Checklist items in the next two weeks then you can probably expect to be through your NVC with no problems. We're praying for you.

On Monday I will have to call NVC again and and request our Petition be move up to a Supervisor for review or at least a Visa Specialist since I know for sure they have all the correct Documents and all of them are completed correctly.

Why NVC asked for the complete copy of my 2011 filing when they already had three years transcript is probably going to remain a mystery. I don't really care why..I only care that my Wife and I are able to move forward in life together. If there is nothing to hide, and nothing incorrect on any of the fields to fill in then you will have no worry's.

(What do you mean under *2011 FULL filing*? could you explain, plz!

)

Yes..in my (our) case it is all Schedules, Forms, and the basic 1040. We have a lot of pages of tax documents. It's all part of the fun of living in a Tax dominated Nation! The advantage is we do not have to pay Earned Income rates. As the Movie script said... "Nutins free in Waterworld!" :o

No response on our DS-3032 :( It sucks to wait, when we are all set with documents and ready to pay and send

When your "time to pay Caesar" comes, and if you do it Electronically, be SURE

to use Internet Explorer to go to the Portal. The Payment Portal does not like

FireFox. It just locks up and refuses to process the payment.

I was really confused about that one until I read a tread here about this. :)

And yes..it does feel good to see that IV and AOS paid notice arrive! The whole

process is waiting and wondering. Not fun.

aha... that's why.

my income tax declaration *book* for 2011 includes 1 page 1040EZ only. ;)

of course I did it. NVC case No. indicated on the each page (upper right corner) of DS-230 and I-864 + supporting docs.

thank you for your usefull comments! Good Luck!!!

I am so sorry. I totally feel your pain. I can relate at least to the slow down of documents. Chin up it will be okay.

You receive that information from NVC, not the embassy (unless you're doing DCF).

Vision exam doesn't matter. Obviously, as I failed laughing.gif Does he have a pair of glasses he can wear to the medical?

He did before but now he switched to lenses. He called one of the panel physicians and she told him if you wear glasses bring them. Although the one he wants to go to is also one of the panel physicians he called them twice and she never mentioned anything about bringing glasses and vision exam. She only said blood test and chest x-ray with like 10 mins check up with the dr.

Thanks a lot for being helpful to all of us here SAYLIN!!!

Did he ask the panel physician what to do if he wears lenses?

And you're very welcome! ^_^
