hello friends,

I am wondering whether would it be a problem if i, the petitioner travel outside US for a couple of months while the I-130 is processing(not approved yet)? does CSC either call or mail in order to ask for the extra supporting documents? Mail wouldn't be a problem for me. Has anyone gone through this situation ? Please share your experience. Thanks in advance.

I don't think it would be a problem - I've never heard of a service center calling the petitioner, they always send an RFE in writing.

What is your priority date?

My F2A/IR-1 journey:

USCIS:
4 August 2011: I-130 sent (while husband permanent resident)
8 August 2011: Priority date
16 April 2013: NOA2

NVC:

7 May 2013: Case number received, DS-3032 sent

15 May 2013: AOS bill received and paid

16 May 2013: AOS package sent

17 May 2013: DS-3032 accepted

20 May 2013: IV bill received and paid

21 May 2013: IV package sent

11 June 2013: response to IV checklist sent

13 June 2013: Case upgraded to CR1

2 July 2013: Case completed

28 August 2013: Interview - approved!

21 September 2013: POE

18 November 2013: Green card received

My husband's citizenship journey:

8 February 2013: N-400 sent
4 March 2013: Biometrics
24 April 2013: Interview
12 June 2013: Oath ceremony

I don't think it would be a problem - I've never heard of a service center calling the petitioner, they always send an RFE in writing.

What is your priority date?

Thanks for your quick response Athena. my PD is Feb 2012 and according to uscis status check, it would take about 13.1 months to get decision.

If you travel within the next few months, you have nothing to worry about as it will take a while before the CSC starts looking at petitions from February. Have a nice trip and good luck with your visa journey!

Thanks again Athena, one quick question should i worry if in case i am still out of US while my i-130 is approved here? Actually i am thinking to travel for 3 months starting from January. what would u suggest?

I don't think it matters if you are out of the country when you get your NOA2 as in any case it is likely that the NVC will not start processing your case right away. If you were to get an RFE instead and you didn't respond to it immediately, your NOA2 would be delayed, but you'd still have plenty of time to complete the processing before your priority date becomes current. Besides, if you can have someone collecting and forwarding your mail, then I don't see why you couldn't be away for three months. Just make sure that despite your absence you will make enough money in 2013 to be able to sponsor your beneficiary (or if you don't, have a co-sponsor lined up).

well my PD is Aug 2011 and I w'll travel next march and I'll stay with my husband at least 5 months, I lost hope from waiting this loooooooong process, in your case I think it is save to go

Don't give up hope. Yeah i know the pain living being separated from spouse. We are in same boat and we can do nothing except hope n wait. Good luck :thumbs:

No, It will not be a problem with the petition - At All.
