Hi everybody.

My name is John and I am recently married. Unfortunately, due to relocation expenses etc, I cannot afford an immigration lawyer and I need to get going on the application for change of status and the permanent residency. However, I have a few areas of concern that I am hoping someone can help me with.

First, am I correct in saying that all relevant forms to be filed are under the heading "Adjustment of Status Forms" on the downloads tab above? If not, what else do I need.

Second, I am concerned and completely unaware as to the order of filing that should be done or if I can submit all the relevant documents at once.

And third, my current situation may cause some areas of forms to be filled out differently so let me explain.

I recently had my H1-B visa extended until August 2014. However, my fiance had to move for her job and so I decided to leave the job and start afresh where we ended up. This rendered me out of status but not unlawful presence as I have not been authorized to work for my current employers. To make matters more complicated, my H1-B renewal was never stamped into my passport as my lawyer had implied that I had to go back to my home country to get it stamped and as my job was quite busy, I never got the time off. So, I have the approval notice which states my I-94 number and validation through August 2014 but that is not what my passport states.

I am simply beyond frustrated and every lawyer I speak to has a different opinion and I keep getting mixed opinions. Basically, I need to get this process moving and I need some very simple help from anyone who knows.

Order in which to file.

Whether to input Approval notice data or expired passport visa data on relevant forms.

Please and thank you very much for any help. My apologies if this comes across as rude or straight to the point, I am simply beyond frustrated with this even at this early point.

Don't worry. you won't need a lawyer.

Possibly. We need to know your situation first. Are you filing for a spouse who is currently living in the USA or outside of the USA? Are they filing for you?

Second, I am concerned and completely unaware as to the order of filing that should be done or if I can submit all the relevant documents at once.

I-130 should be filed always. If your spouse is living with you in the USA, then you file for adjustment of status.

Don't leave the country if you are out of status. You could be denied re-entry, even with an immigration visa.

Which country does your spouse live in? The USA? If so, then go up to Guides and click on 'US Citizen and Spouse Both Live/Reside in the USA.'

Once you click on that, the instructions that follow should be appropriate.

Others could chime in to let you know if there is a special circumstance regarding your present "out of status" status.

04/04/2022: Check for passport cashed.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
