How long does one have to respond to the NVC?

I didn't really get an adequate answer in the NVC forum, so I was hoping you guys had an opinion.

After filing an I-130 and getting an approval notice for a CR1 visa the NVC then sends out its packet which contains forums such as the I-864 and DS-230.

However, no clear deadline on responnce time is stated.

There is one line in the packet that says:

"If a period of one year passes without contacting NVC (by telphone or mail), all submitted fees and documents will expire. In this case, fees and documents will need to be resubmitted in order to continue the immigration process."

But what fees and documents would expire? The I-130 and its NOA2 never expire. What happens after a year?

The petition will be sent back to USCIS with a recommendation that the approval be withdrawn because the petition has been abandoned.

Or, the petition will continue to collect dust at the NVC because returning abandoned petitions to the USCIS is a lower priority than processing petitions in which the beneficiary and petitoner are showing some interest.

Our US app took forever and the i130 was actually approved after I (USC) moved to Canada. 1 year after we got the first letter from NVC we got a second saying that it had been a year, all forms and fees sent to NVC were now expired, and if they didn't hear from us in 1 more year the whole application would be thrown out-I assumed that included the i130 approval.

summer fling failed to fizzle, married 2003

I-130 mailed 12/15/03

4/1/04 no word from NE contacted senators office, app found

NOA1 4/13/04

Gave up on ridiculously long US process-started Canadian

12/4/04 submitted app

LSS app returned because of missed signatures, lost in transit, resubmitted in June

9/28/05 landed, yippie

10/4/05 fly back to US to "finish up Master's" lose mind and switch to PhD

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa

So based on your experience you actually got 2 years? I am amazed you got a response after the first year went buy. The reason I believe I-130 don't just expire is because people to this day still adjust under 245i based on approved I-130's from the late 1990's.

I'd read some simular stories about the i130 never expiring, but am not sure if I totally believe that. We hadn't sent anything to NVC in the first year so I can't even say if forms and fees would have really been discarded. We would rather live in Canada, we're only resuming the US process so we can live together while I go to school-so it's not like I researched enough to see if I could send in the i130 then let it sit several years. That's up to you if you want to take that risk.
