Hi to all. I will appreciate all your help to answer my questions as I am feeling depressed confused and tense. me and my husband is currently in the process of visa. I-130 approved, Ds 3032 sent. AOS bill paid and AOS sent. I still have few steps which is the Application for immigrant visa and Medical. But unfortunately, My husband suddenly transported my child to the united states and dont wanna bring back in japan where we currently stationed. He threaten me that I I cant do anything to get my son back and he will divorce me due to his stress at work and we fights all the time and that he will cancel my visa so i wont get to see my child. Is it possible to expedite my visa and what if he will cancel it before my case will be completed.

I'm sorry I can't answer your questions in an immigration sense, but with a legal background, I have to say - please get legal help immediately.

If I understand your post correctly, your husband has returned to the USA with your child - without your approval?

The Hague Convention protects the rights of the child, and a child cannot be removed from its place of birth/where it perceives as being its home, without the approval of both legal parents. What he has allegedly done is illegal!

I feel incredibly sorry for you - what a horrible feeling it must be to be without your son :( Do you think you possibly signed something giving him sole custody and the right to remove your son from Japan? Does your husband not need to return to Japan to fulfil his duties? Or has he abandoned his military job also? That's two very serious crimes he may have just committed!

If you're just waiting for an interview with the embassy, and since you're abroad meaning you probably did a direct consulate filing, then you are probably unable to do anything more. Call and explain your situation perhaps? Is your son a citizen of another country besides the USA?
