First time posting here!

I got married about a month ago and we're preparing to file for adjustment. She's still student and doesn't earn enough. I earn almost twice as much as the required poverty limit and we don't (yet) have a sponsor and didn't think we would need to until today. However, I was given two different opinions by two lawyers on this matter. I'm on F-1 OPT and have been working since March 2012 and have a very stable job. Because of graduate school, I didn't work from Jan 2010 to Feb 2012. Which means I never filed for taxes for those two years. According to one lawyer, it's just a matter of writing an explanation letter and submitting my income together with my wife's on the I-864. According to the next lawyer, I can't be listed under the household income because I can't show tax documents for the past year.

What do I do? I'm scheduled with yet another lawyer to get a third opinion this weekend. But has anyone gone through the same issue?

You should be ok; tax filings are good, and there is a small chance they may delay till you file (which you could do in January...), but as long as you have paystubs and a letter from the employer stating they will keep you on past the one year OPT, there should be no problem.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
